Driving home from work and someone has gone in to me and hit my nearside rear quarter... fuming!

now that's really not nice chap, if I was you i'd be somewhat depressed now to say the least, did you get the other drivers details and were there any witnesses.
going on your luck with this car so far i'd be inclined move it on for something else , it seems to have a major curse on it and you're having one issue after another.
anyway, good luck with things.

I got his details yea chap. He works for a recovery company. Just about had enough of the bad luck now. Not sure if it will be classed as a right off.

Sorry to hear this Darren. Hope it's sorted out quickly for you

update.

so the other drivers insurance company contacted me yesterday an advised me that he has put me at fault!!! to say I am p*ssed off is an understatement. there is literally no way I was at fault in any way. he has tried saying I went through a red light which has annoyed me even more.

Cheek of everyone nowadays - argue it, many insurers just settle now. My sister in law had to ring her own insurance company to tell them not to settle as the other fellah was lying.

Easy option nowadays

I think they may just write it off chap, when I had my done last month the final bill was just under 3k and I had no rear panel such as you have, but the insurance company engineer said if it had need rear panel work it would have been a lot more expensive, the whole will need repraying along with bumper a lot of work to remove all the interior trim etc and then sort out the panel and possibly anything that may have been damaged inside the wheel arch, its probably not what you want to hear chap but don't be surprised if they do want to write it off, I hope not but anything is possible.

Yea I was kind of thinking that too bud. Daft question but what would I get paid if it was written off? Would it be what the insurance company have it valued at?

not 100% sure , I have the same model as you , lower milage but still the same variant, when I called the insurance company to make my claim they asked me what the damage was after which they said they would write it off based on the amount of damage and the approx cost , but, they would need to get an upto date valuation of my car, initially they quoted me £5-6k as a write off payment, I then told to think again and told them what specific model it was , and all the details, they then changed there tune and said approx. £9k , they said there first quote was based on a base line model A4 with 100k miles, mine wasn't that by any means.
anyway , insurance engineer also confirmed the same value when he came out to assess the damage etc , so worth keeping that in mind that if they do want to write it off don't let them value it as a base A4 model otherwise you'll get a silly cheap price offered.

If they do write it off buy it back, that can be repaired quite easily by a good back street bodywork guy, i see much worse than that every week in the bodyshop next to my unit, they come out like new.

Just out of interest at what price do they expect you to buy it back at

Depends on a lot of things, how old is the car, what's it worth ( in good nick )

Just as example say they paid you out 3k you could possibly buy it back for £500, you have to haggle & haggle hard, go in low you can always come up a bit.

sorry to say this but im glad im not the only person that seems to hve bad luck as my car has been hit 3 times.
but agree if it is a write off try and buy back and get fixed a freind managed to buy his car back only a pug 206 but only had to pay a £150 for it

Had similar looking damage after a lorry clipped me approaching the Dartford Tunnel.
£150 to repair and looks like new. Wasn't worth going through the insurance.
Go and speak with some local body shops.
Good luck!

I don't think you'll get that repaired for that sort of money anywhere to be honest, just the cost of respraying the side alone is going to be a fair few pounds even for a cash job , well a half decent paint job that is.

my recent ding came in at £3450.00 and that was done at my local guy who is first rate and not expensive, ins company also agreed the price was right based on the Thatcham method of pricing repairs.

If it's one person's word against another then the best outcome is to just settle it. Insurer pays your repairs, other side pays theirs, that's it.

Say you decide to fight it, the two insurers spend ages arguing, even though it's your word against theirs, they can't agree so they appoint lawyers costs £100s an hour, that doesn't resolve things so it goes to court which is more legal costs and charges. The judge listens to you speak and the other party speak then decides that as there's no independent witness, it will be split liability. The outcome is exactly the same except your claim has now cost about £15k instead of £2k. The only people better off are the lawyers.

If you've got a witness or CCTV or something then yeah fight it, otherwise it's a bit pointless.

And the insurer's got to get that money back sometimes so guess what....higher premiums next year.

It's people not accepting liability for accidents which are their fault, not the insurer which is to blame.

Well a bit of an update for you all. I've been making sure I got my point across to his insurance company with emails, pics, phones calls etc. It's taken a long time but they have actually taken liability for the accident now.

Got their engineer coming tomorrow so I can find out when the fait will be of my car.

well thats an improvment chap, just hope the engineer thinks its a cost effective repair, fingers crossed chap.

Cheers bud. If he does decide to write it off I may look into buying it back if it's worth while me doing so.

They probably realised that his story didn't hold merit. Is it just a waiting game now? Are your insurance company involved?

Yea just waiting mate. I informed my insurance but they aren't involved.

In all fairness his insurance company have been really good. They called me the other day and said if and when I need a hire car they will get me one.

Will you get a hire car then? I wonder if the fact they other guy didn't take liability straight away cause issues when he comes to renew his insurance.

Yea they have sorted a hire car for me bud.

Possibly yea. He drives for a living so don't know how it will affect him really.
