Discussion, Who is at fault here? Cyclist has a lucky escape

Picked up this little bit of footage on my dash cam earlier. There are arguments for both parties

 
Trying to figure out why the cyclist was where he was. It looks like there is a right turn there, was he trying to make that right turn? Because from the road markings I dont think a right turn is allowed there. And if he wasnt turning right then he essentially overtook you. In court it will always be the driver at fault however - as far as I know.
 
The cyclists fault. He overtook you without checking if anyone was pulling out of that junction. You had already stopped to allow a vehicle out so the cyclist should have thought about that and looked a bit better. It's hard to expect the driver who is pulling out to check if you are being overtaken because it's safe to assume that all other road users behind you should have enough sense to read the situation better.

As above though, will always go down as the driver of the motor vehicle at fault if the courts have anything to do with it. Police are more likely to side with the driver however
 
Cyclist. He overtook on the White lines, in theory there's no road there, so he deserves to feel like a tit !!

He shouldn't have overtaken you.
 
As a cyclist who does rides 15,000 miles a year - most definitely the cyclist. Stupid overtake.

That moron of a cyclist, you stopped to let a car out car pulls out expecting it to be clear not some bellend of a cyclist to overtake you on white hatchings where strictly speaking it's not a road so shame he didn't get twatted by the RenaultRenault

he's in the hatched area of road, crossed the white line into turn the right lane fro the oncoming traffic, and proceeding at a speed that is too fast fro the situation.
i'm a lapsed motorbiker, if I had done that manouvere, it would have been at walking pace, still wrong but gives me a chance to stop, and I would have expected a car to be pulling out, that's why the gap was there
no doubt if the cyclist had a head cam, it would be on you tube claiming that another dickhead motorist had tried to kill him

have cyclists never heard of defensive driving
 
I am a keen cyclist and it annoys the Hell out of just how stupid some of my fellow riders are. In that case the cyclist was performing a pass manoeuvre where he shouldn't have.

My pet hate locally is the number of cyclist who ride on the very busy roads rather than the well maintained cycle tracks that run right next to them.

Cyclist for sure. However..... I could swear that Renault tried to take him out :blink: I would've stopped had I seen a lycra clad guy essentially leant on my bumper!
 
as a driver, cyclist and biker i've been on both sides - that was cyclists fault, over taking approaching and oncoming turning and at a junction.

bet his lycra was a tad moist...

Cyclist at fault so is the woman cyclist who undertakes the car, what if the driver had turned left?
