    is this fair?

    to cut a very long story short, six months ago i found out the last 5 stamps in my service book where from a garage that said they never have had my car in for service. fast forward 6 months and trading standards involvement and they have offered me a 200 good will gesture, or I take them to court. part of me just wants shut of the whole ordeal but part of me thinks its a bit low as they've knobbed me about for six months. what you guys think?
    A4 B6 1.9 tdi 130. Slowly modding but don't tell the missus.

    I take it this is with a previous owner who "bought a stamp" rather than you sending the car in and paying for work which wasn't done?

    How much would not having a FSH affect the resale value of your car do you think?

    not sure. the previous owner was a very elderly gent so not sure if he fudged it or the dealer just stamped it and ripped him off?

    this is a big dealer and they said he's had the car in for MOT but they've no record of having serviced it on the system or cant find any parts ordered for it.

    can't name and shame in case it goes to court. they are arguing that they've already lost money on the car as the clutch and dmf went on the day i bought it. i can see their point but its not my fault it went.

    i've still got this prob where there is a booming noise at 2100 rpm, but it disappears after that and as it's been warmer the last few days its not doing it. seems to be temp related and i dont want to accept 200quid then the prob turn out to be a massive bill.

    Back up a bit, did they sell you the car as otherwise I fail to see why they lost money cause your car clutch/dmf failed.

    yes they sold me the car and on my way home the dmf failed on a hill start. it was fixed under warranty.

    no sorry. the place that sold me the car isn't the dealer that serviced it. it was sold and advertised as having full service history and had been fully serviced 200 miles before i bought it. the car started to run badly and the fuel and air filter were really really old. the place that serviced for me reckon they where at least a couple of years old so i called the dealer that had stamped my service book.

    i had this kind of think with my last car and only wished i had give it back to them and got my money back the book had been stamped but car had not been done turns out they had clocked it too and in the 3 years i had the car it cost me more than i paid for it in parts if you ask me give them the car back they cant say no as they sold you some thing that is not what they said. and all garges are very stricked when they buy cars in they always check them out and this kind of thing would show up i would have thought so they no it was a fixed fsh book and dont let them say they did not

    the mileage is definitely correct that's one saving grace but I'm thinking the same as you, surely they checked the history before advertising it as such.

    they have top mate there is not one garge in this world that would just take a car in with out doing every check pos so i would not think for one sec they did not no about it like i say id be asking for my money back asap and then buy a new one there is loads out there

    You should ask the garage for a full warranty to cover every part of that car for the next year or 2, then also ask for some compensation, plus tell them if they dont cough up then vosa, dvla etc etc will be made aware of there practises, disgusting & ytf should you feel sorry for the clutch/dmf issues, they sold the car, there problem, at end of day they will end up in a world of poo for that if they dont make you happy imho.

    Its fraud and deception to sell you an item that is not as advertised, How do you know that the dealer that sold you the car has not got a dodgy stamp out the back ? Id be talking to the police about this one,

    My point is this, when you go to sell the car, and the next owner decides to look into its service history and finds what you find, who's arse is going to be called in? YOURS!

    bit of an update. i sent them a letter saying i refused the offer and to let me know within 14 days what they where going to do or i go to court (this has been going on since august) and they sent me a reply saying they wouldnt increase the offer, they would defend their reputation at any cost and that i cant blame them because the dealer who has stamped my book has lost their records. They also sent a letter from the previous owner saying he had it serviced at the dealer but could not provide any proof such as receipts. thoughts gents?

    they are just trying it on iv you get trading standereds on there case and call the local government ombudsman and let them sort it out for its all free and they will get the job done no garge will want tranding standereds on there back going through all there records and to say the guy that had the car before you sent a letter but has no prof what a load of **** he can pick up any of his bank statmants and there would be prof

    Deanski, got a best mate in a similar fix and trading standards have backed him to the hilt. THe issue is not with the garage who's service stamp appears until such times as you can proove that the car went there. You have to win the case with the dealer who sold you the car. It is for them to take the fight to the garage if they so desire. You are right not to name an shame on here, if it does go to court, solicitors will be looking high and low for foul play and that would be ammo for them.

    No point talking to the police yet as you cannot show any criminal intent on the part of the garage. IN any case since criminal cases outrank civil ones, all it would do is delay your case reaching a county court as nothing would happen until the criminal investigation was concluded.

    200 is a micky take, i would be looking for an inspection by an independent VAG specialist and all non wear and tear items being taken care of, or handing the car back. Without doing this you may as well just bin he service book.

    Go to court to get them to take the car back claiming any losses i.e. anything you have bought for the car and compansation for the whole ordeal and court costs.

    i agree and say f**K them its down to them to make sure the car is what they say it is when they sell it not you and if its not as they stated ie the fsh can not be proved its not what you paid for id not let this go if it was me as much as it can get to you and make you want to give up you have gone a long way with it now so just see it throu mate

    well its going to court but trading standards are saying the difference in price between an a4 with history and one without is 250!! I give up.

    try to get examples of cars advertised with and without service,

    go to a couple of dealers & ask if they can give you a price based on the car with/without service. problem is, this needs to stand up in court so needs to be something in writing by an independant party (this is where you will struggle)

    ok i think trading standards and the place you got the car from are missing the point here its not about what the car should have been worth its the point you was misslead when buying the car id stick to my guns and say i want my money back as i was sold a car that stated it had a fsh and it really has no trackable history at all its not the 250 pounds here its the not noing how the car has been looked after or not looked after

    I agree with simon, the point is not what the car is worth. At best you have been mis-sold and should get ALL your money back (but be prepared to had back the vehicle), at worst it has been fraudulently mis-sold and that is a very serious matter that trading standards should be focussed on regardless of your predicimant.

    However you don't seem to make it clear what result you want out of it? Do you want to hand back the car and get your money back? Do you want to have it fully serviced up to manufacturers standard so that you have a baseline again? Do you just want a discount on the price you paid?

    It seems the offer is made on the basis of the latter and that depending on the age of the vehicle could indeed be fair. It all depends what outcome you want from it?

    Once you've got that, only then report them for suspected criminal activity if you think they have faked it.

    5 false stamps, i would imagine that's at least 5 years worth of stamps which i know on a used car of an older car isn't worth as much. but a half decent car full service history to part will take a big hit

    i want (and have offered to accept) the car to be fully inspected by audi or a specialist, and double checked everything is ok. if it is then fair enough. what i dont want is to be fobbed off with 200 notes then 6 months down the line the car develop a serious fault through inproper servicing.

    sounds fair to me mate just bear in mind if they check it today and 5 days latter it some thing gose wrong you have no come back so id try and get them to stump up for a adui warrnty as well

    Sell your story to the news papers, the garage will soon be nice to you when a nati0onal or local news paper is on the phone asking them questions about the story as its going to print.
