    Hmm!! Getting a bit heated this one, I'd normally love to comment, but I think I will leave it. Other than to say were there any road markings indicating what lane to be in to take what exit?

    basically i was on the roundabout i was in the wrong lane i taped the indicator right and carryed going round the roundabout, i was already in the lane for the exit and just as i exited the person has moved left into the back of my drivers side rear wheel. but the guy behind me was quite close do i think he has just tryed to get in the gap

    At the end of the day the damage is done! The worst you can expect is 100% blame, the best 50-50, either way it's an insurance job and that's why we have insurance!................................You do have insurance??

    hello does anyone know what the insurance repair would do to my car its only got a few scratches, 1 on the drivers side rear just about the rear wheel and a few scratches on the bumper. im sure its a repairable but would they repair it or replace the damaged panels

    If you can safely take some pictures of the roundabout including the closed exit, and where the spot accident happened prefebably someone else driving in the lane you was driving in etc.
    Incase it goes to mediation or court.

    im goning to send the calims form tomorrow and the accisent is about an hour away from me, i could go and take photos if it will help a lot.
    i read that a lot of accidents on roundabouts go 50/50 and i dont want to lose my ncb if that happens, but my insurance said i can pay to fix the car if this happens which i would do deoending on if they repair the damage or replace the damaged panel becuase its not a lot of damage
    a slight dent a a few scratches

    Taken from the Road traffic act. and can be found in the highway code, The Code will not stand up in court tho.

    161. When reaching the roundabout you should

    give priority to traffic approaching from your right, unless directed otherwise by signs, road markings or traffic lights
    check whether road markings allow you to enter the roundabout without giving way. If so, proceed, but still look to the right before joining
    watch out for vehicles already on the roundabout; be aware they may not be signalling correctly or at all
    look forward before moving off to make sure traffic in front has moved off.

    162. Signals and position, unless signs or markings indicate otherwise.

    When taking the first exit
    signal left and approach in the left-hand lane
    keep to the left on the roundabout and continue signalling left to leave.

    When taking any intermediate exit
    select the appropriate lane on approach to and on the roundabout, signalling as necessary
    stay in this lane until you need to alter course to exit the roundabout
    signal left after you have passed the exit before the one you want.

    When taking the last exit or going full circle
    signal right and approach in the right-hand lane
    keep to the right on the roundabout until you need to change lanes to exit the roundabout

    My friends have had a couple of incidents on roundabouts and they've always gone 50/50.
    It's very unlikely that the blame would be put solely on one person. I'd be prepared to just pay yourself.
    Also watch out for these companies that offer you a hire car. My brother was given a brand new 320d Sport Coupe which he had for 8 weeks whilst his 323ci was being repaired. The other insurance company started phoning him to pay the charges. Basically this hire car company charged about 6000 for the 8 week hire then the garage charged 5000 for the repair.
    The car needed a new passanger door and rear qtr panel..... These insurance companies are the leaches of society!

    Don't you just hate it when drivers go right round the roundabout without signaling and then signal off at the exit.... WTF

    Other drivers have to guess which exits they want to take.... and then if you show your grievance they say that they were indicating.....

    This is also my pet hate.
    The junction is controlled by a roundabout and you have turned right from the nearside lane.
    You would not think to do this at any other junction on the planet, but I bet there was no queue on the nearside lane and you thought you would have a go eh?
    The bottom line is YOU SHOULD NOT HAVE BEEN IN THAT LANE and that is why the accident occured.
    Get in the right lane and read a highway code please!

    I personally think it should be 50/50 as you were both at fault.

    You were in the wrong lane (which winds me up no end) He/She (which one is it btw as you have said both) hit you from behind.

    I dont know alot about law, but you should probably loose your ncb or have to pay as you drove round a rounderbout in the wrong lane, ultimatly causing an accident.

    Yeah the other person hit OP, but OP should not have been there (in that lane), and if he wasn't (in the wrong lane) then there would have been no accident.

    It's a bit like getting into an accident with someone who has no road tax. Wouldn't matter if I ploughed straight into the back of them, the fact they had no tax and therefore should not have been on that bit of road at that time means they are at fault.

    there was no in the right lane it wasnt a bust roundabout. the point of contact i was in the correct lane to take the exit
    its all been sorted now

    I'm having real trouble getting my head around that, aythree

    Say I'm sat in my insured, roadworthy car, on the 2nd of June on the way to the post orifice to get some tax (a day late due to the bank holiday) and some nugget ploughs into me at 100 mph, then what, tough ****?

    Not having a go at you m8 I just think there is far too much importance attached to that little circle of expensive paper (which is for f**k all really - what are the roads like round your way?)

    I can't be 100% sure but yes, I think it is tough titty, you should have got the tax in time for the expiry of the old one.
    I'm guessing they'd ask why you didn't buy the tax before the bank holiday weekend, or do it online.
    They can even fine you for owning a tax disc but not displaying it properly, so I reckon they'd have no problem doing you for having no tax at all.

    And doesn't having no tax invalidate your insurance??

    Basically, road tax, along with MOT and insurance, is your right to be on the road. And without any one of them you have no right to be on the road.

    But you are right, there is a bit too much importance attached to that little round bit of paper. But thems the rules.

    Hmmm...explanation time is in order! I've only lived in Germany since October last year - from 1995 to 2008 I have spent many joyful moments on the roundabouts of the United Kingdom. Joyful because it always rains, and I used to drive BMWs. so

    Just for a laugh, there's a roundabout 100 yards from my office. It's true, zee churmans are not a nation big on roundabouts, and they don't generally know how to use them. I show them though

    I know many things of these things called roundabouts. Have experienced, joy, pain, and write-offs. My passengers are on the most part glad not to ride with me any more

    My experience of them was a nightmare at times, as they are/were so few in NRW, you would have people giving way to the right and all other manner of mentalness.

    I did notice that down near you (and the likes) the bigger cities were catching on to them though.

    BTW: not that I have an unhealthy interest in your personal circumstances or posts, I did workout you are from these parts originally. If nothing else...you have a sense of humour!

    AuldReekie - They are a nightmare, for exactly the reasons you stated...I haven't had a crash yet, but if I keep using them properly, it may well happen

    Had somebody give me the ****er sign the other day for using a roundabout in the proper manner...I think he thought that because all the traffic was moving slowly I must give way to him, hmm, that didn't work! Made it worse for himself because I stopped, and reversed, and made him wait a lil' bit longer

    I love being a foreigner. It's awesome

    There is a difference between an avoidable accident and an unavoidable accident. If the driver of the 4x4 had been paying attention then there wouldn't have been an accident either, sure they could be annoyed at missing the turn & have go round about. I'm sure its law to look over your shoulder before changing lanes.

    spoke to an insurance guy and he said basically the same thing
    he moved into my lane he has to leave enough room to chnage lane

    Will people stop saying that he was in the wrong lane? Without seeing the roundabout, the signs on approaching roads and the road markings nobody knows whether he was in the correct lane or not.

    I had the same thing happen to me a couple of years ago, only they hit the front of my car. The driver was having a real rant at me for being in the wrong lane, so I calmly walked with her back to the road we had just come from and pointed out the arrows painted on the road showing that BOTH lanes should be used for turning right. She apologised immediately. People just need to learn to drive properly and pay attention to the road signs and markings.

    I think it would end up being an equal blame situation with you both being in the wrong. People trying to turn right from a left lane deserve to be shot. No sympathy from me here - you were hit because you placed your car in an unexpected position, most probably in the other drivers blind spot. If it were me that hit you, I'd take you to court.
