My A3 experience so far...

OK so as some of you might recall, I bought a used Audi A3 (see my sig for spec) about 7 weeks ago. All seemed fine at first but over the next week or two I discovered several problems with it:

Rear windscreen wiper washer did not work
Light in boot did not work
Tremble in steering wheel at high speeds
Juddery at idle
Engine revving too high and then coming back down under hard acceleration
Engine coolant leaking
CD player did not work

I told the dealer I bought it from about all of these issues and they told me to bring it in the next weekend which I did - I dropped it off on saturday morning and picked it up on sunday afternoon and all they had done was replaced the CD player... with one that did not work at all (previously the radio worked, but now the thing would even turn on) so I was without any kind of music for the next week. Anyway, long story short, I took it back to them 3 weeks ago and asked them to fix everything else so they took it in and gave me a courtesy car (a 2006 ford mondeo estate that has a few problems of its own). This was 3 weeks ago and I am still driving the courtesy car as so far they say they have only fixed the coolant leaking problem, the CD player and the boot light. I'm guessing I wont get it back for at least another week, which is very annoying as this courtesy car is horrific to drive on snow/ice due to it pulling to the left and generally feeling unstable (and I drive at least 2 hours every day just getting to work and back, 4 hours a day on Tuesdays and Wednesdays).

I was just wondering if any of you think I have the right to just tell them to give me money back and I'll go buy one from somewhere else or are these issues not serious enough for that?

Also, does anyone know if the rear wiper washer is required to work for a car to pass its MOT as the car was given an MOT by them the day before I picked it up originally and the rear windscreen wiper washer has never worked on it?

Sorry to hear this, I know all about shoddy dealers. Was it an approved used car? If it was then you have a 30 day exchange, use that or put the pressure on them by calling Audi UK, threatening to call trading standards etc. This should speed up the process and get you some free stuff.

Thanks for the reply, sorry I should have specified that is was just a general used car dealership not an Audi dealer or anything. I'll take a look at that link cheers
 
Erm. Does it have full Audi service history , or any service history ?
If it was a used car lot , then yes you have the 90 days , but this is to correct any issues you have with the car , not a refund.

I would check the service book and see about the service history , i would suggest also having an independent look at at..

3 weeks is taking the **** in my eyes , i would drop in unannounced one morning / day and just walk in and see if you can see the car , if its just sat there i would ask what the F%£$%Ks going on...

Also do you have a note of the millage when you dropped it back in ? , if not then it will be on the MOT , then estimate your millage done since ownership and see what it is at now..

Who is the dealership you got it from >?
Do they have a web site >?

I do not want to wind you up , as i am sure you are stressed enough , but i would i simply be kicking off royal by now.

As far as the curtsey car goes , where is the curtsey in that ! i would expect the same car or better , not worse.

Get down there and see what;s really going on.

sorry to hear about all your problems, I know only too well how frustrating this sort of situation is!

I part exed my 2000 audi a3 quattro recently for a 2005 Saab 9/3 estate. Everything went well on the test drive, obviously a very different car so I expected it to feel a little alien and going from a turbo petrol to a diesel i also expected a drop in power... but in the name of practicality and economy i took the plunge. I also hoped that with this being a much newer car with full service history and only 40k on the clock it would be more reliable etc...

anyways long story short I had it for about a week and had all sorts of problems, wing mirror fell off, indicators stopped working, engine management lights came on, wouldn't start on occasion, wobbly steering issues, squeaky interior etc etc... Overall i was hugely disappointed and missed my old car (which was 5 years older and about 8 grand cheaper!!)

So... i was a bit stuck to say the least, the finance had gone through and id sent off the forms to the DVLA, but some friends in the know advised me to look into trading standards on used cars and after a good read I was happy to discover you have a 'reasonable amount of time' to refuse a used car under certain circumstances. These include the car not being 'reasonably reliable' and 'of a satisfactory standard for its age and mileage'.

Now these are pretty loose terms but seeing that people have successfully won cases up to 2 months from buying a used car and with older cars than mine, i felt i had cause for complaint and was confident I could reverse the deal.

The dealer has the right to offer a repair but you also have the right to refuse this if you feel the car doesn't fill the above standards etc... so dont be fobbed off, they tried it with me and i stood my ground (with three of them in the room) and they even tried to tell me they were characteristics of the car etc etc...

So ... a few weeks ago i got my audi back, reversed the switch with DVLA, cancelled the black horse finance and now have a new 2006 Audi A3 sportback... bought with Evans Halshaw who have been great and include a 90 day guarantee.

If i were you I would get stuck in and get the whole thing cancelled or at least demand the fix everything yesterday. Good luck and if there is anything i can do send me a PM and ill get you the info i looked up when i reversed my deal ;)
 
On one of my previois BMWs, I had issues, so I went back to the dealers, and just sat in there showroom untill they sorted out my issues. I dont think they appreciated me telling the customers coming in not to bother due to the lack of service I was receiving! They soon changed their act.

Put your foot down lad! Or up their ****!
 
Did you pay using finance/HP ? If so, let your finance company know as well. Basically it is their car until you make the final payment and they are responsible.

Years ago I had an Astra that was constantly breaking down, I ended up giving it back to the finance company as it was undriveable.
 
Nah I didnt get it on finance/HP but thanks for the tip, I'll bear that in mind in future if I buy a car on finance.

I got the car back yesterday, bearing in mind its been with the dealer for just under a month - surprise surprise most of the problems have not been fixed! It still revs too high when accelerating (which is the worst problem), its still shakey at idle, the CD player now works but the volume control button is stuck too far into the unit so its almost impossible to change the volume, and even the rear windscreen washer has not been fixed.
I called the dealer today and explained that it was still having all sorts of problems - to which they replied with "no its fine"... So after about 10 minutes of me explained that IT IS NOT FINE and that I dont care if he saw the rear wiper spray working, it sure as hell doesnt work now and never has when I have driven the car. He said "we will buy the car back from you" but to me that does not sound the same as them giving me a full refund... anyway, the service manager is going to give me a call on Monday so I will have it out with him then. Assuming I do get most/all of my money back, I'm going to need to buy another car pretty sharpish so that I can get to work so I've been looking on autotrader. I found this one but the price seems a bit too good to be true when you consider that older models with more miles are on there for more than that: Audi A3 2.0 TDI - what do you guys think?

Spoke to the dealer again today and they now say that they did not tell me they would buy the car back from me and that they just said "it sounds like you want us to buy the car back from you".... but I'm pretty sure that is not what they said. They promised to give me a call back later today but its now 3 minutes to 5 so it doesnt look like that is going to happen! Getting very annoying!
 
I'm extremely new on here, but that won't stop me saying my piece. I'm not a mechanic, so I certainly won't try and answer why your car is misbehaving like it is.

But as for the service you are receiving, its totally unacceptable. You have chosen to buy this car from a dealer because it usually gives you some peace of mind that they will sort out and fundamental problems that have come with the car, but it looks like they are simply shrugging their shoulders and hoping you will go away. I'm afraid you have to be totally ruthless now, and simply throw the book at them. No need to get aggressive or posturing. But just stand your ground, and tell them like it is. I know it doesnt come naturally to a lot of people. Most of us simply try to be civilised and nice, and hope this can resolve it. But this is your hard earned money that is at stake here. I don't blame them for initially selling you car that turned out to be duff. I've been in a similar game in which I sold things that I presumed and tested as working (IT gear), but ocassionally, within a period of time, there would be the odd failure, and the ball was in my court to do something about it. But they are clearly fobbing you off, and quite why it took them 3 weeks to sort out a few bits and pieces I don't know. There are indeed rules and regulations governing car sales and what you can do if you feel you have been sold a duff, most of these have been pointed out on here, and again, I'm no expert when it comes to this area. But what I can tell is stand up to them, take no s*** and you will be amazed at what you will get in return.

Thanks for the support stonesfan :) after that last post I called them again and they said they would ring me when I got home from work at 6 PM. Of course they didnt, so I called them back at 6:15 and asked why no one had got back to me (yet again!) and I got "what? Simon hasnt called you? He told me he had..." etc etc, more bull. He then said "give me 2 minutes and I will get him to call you straight away" - its now 3 hours later and I obviously have not heard anything. Called them several times in the last couple of hours but no answer. Tomorrow I am going to call them at lunch and I dont care who I speak to I am going to tell them that this is just getting stupid and I want a full refund as soon as possible. Will update this thread with the progress tomorrow evening!
 
Dude , Firstly who is this dealer you have bought the car from ???? Just post it on here , whats the problem with that ?

Always check what has been repaired at the dealer with a member of staff present.

Secondly this may not be what you want to hear , but you asked so i will be honest.

I feel i need to shake you up in a bag and tell you that they are taking the pi$$ , they can not take your car for a month it's absolutely ridicules for the problems you have listed.

The cd player no issue it's broken lets face it, so needs replacing... no drama.

But the main issues here are the mechanical ones and as said above great advise STAND YOUR GROUND.

Personally i would be taking legal action by now, i am not joking.

Nearly a month with out it , no way in hell.

I am so annoyed by this i feel i need to ring them for you ! sorry dude but you need to man up and get down there say it how it is.

They have had there chance.

Simply put the car is not as advertised.
 
To be fair Crypric, not everyone is used to this kind of situation. Its pretty daunting when you are faced with a company which clearly has no customer service skills. Quite a few people are just naturally nice who try to resolve things through smiling and being diplomatic. But as I've said, its his hard earned dough that is at stake here, and if a full refund is not forthcoming, this car could end up costing him a load more to put right once the warranty expires. Thats what Chris needs to use as some motivation to say enough is enough get his dough back whilst he can.
 
Well I called the dealer today and they said I have to bring it back to them again for them to fix it. I said no you have already had it a month, I want my money back... to which they responded with "well that isnt going to happen" ..... I argued with them for ages, threatened to get trading standards involved and take legal action and they just said fine if thats what you want to do. The most annoying thing is that he was like "we have bent over backwards to help you with this" - what the hell!! They cant even return my calls, or fix the car, gave me a courtesy car that was a piece of sh*t, and I've had to drive there (an hour away from me) a couple of times to deliver the car for repairs - I fail to see how they have bent over backwards for me (not to mention the time I drove all the way there and left the car there the entire weekend and they did absolutely nothing with it). He just kept saying that if I wouldnt bring the car back in for repair then its my problem, I said you have had the car for a month and its got pretty much all of the problems it had originally but he said well only you say its got these problems, none of our mechanics found anything wrong with it. I also found out today that the engine coolant is still leaking, in the 4 days I have had the car back it has gone from being just over the max level to a bit below the min level... so I'm going to have to go and buy some more coolant and put that in it every few days until this whole mess is sorted. What do you think I should do next? I told him he would be receiving a letter from me shortly telling him that I am taking legal action, but I guess I need to speak to citizens advice or something and find out exactly what I need to put in this letter? Also, how can I prove anything if this does go to court? I've got videos of the revving problems and a picture of the engine coolant when it has nearly run out, but they dont really PROVE anything. When they sent the car back to me I asked them to send me a list of everything they had done but as yet I have not received this, I'm hoping it is already in the post otherwise they probably wont bother now.

In my experience not the way to handle it at all - if I was the dealer, I'd have escorted you off the premises, or failing that got the police to. Getting their back up will often make things worse.

Anyway back to the OP - you have every right to expect them to fix it in a "reasonable" amount of time - take the car back - list all the faults in writing, then demand it's all rectified within 14 days. If that doesn't happen, then you'd have a good chance to demand a refund, but to do that you'd need to go to court - by no means risk free, and expensive if the judge disagrees with you. If the dealer isn't prepared to offer your money back without a fight, and you don't want a legal fight, then your best option is just trying to get the problems resolved.
 
I would take the car back in once again , get the person that you are speaking to or a least the service manager ( not some receptionist ) , go through each point that needs addressing.

Take a written list of the faults with you and get him to sign a copy acknowledging receipt , keep that copy for you and leave him a copy.

Request a completion time and date for the faults , with in reason to be made good.

Make sure they give you an acceptable courtesy car.

When the agreed time arrives , go back with the list and go through them with the same person to see that they are complete, the coolant is a tough One as it can be a slow leak ( maybe go for a drive with him ? )

Do not leave with the car unless you are 100% happy that the work is complete.

If this fails then at least you have a list of agreed work , that they have signed , any thing before this is verbal and does not really count for much in legal terms.

I would would also suggest that you document everything from day One to present.

Is this work under warranty ?

If so then the warranty does not have to be at this dealer you can take the car to a different dealer , to get the work done.


WHO IS THE DEALER YOU BOUGHT THE CAR FROM ?
 
The dealer is CSG (http://www.csg-autopark.co.uk/10921/autopark.htm) but I dont see why that makes any difference to anything?

I have already been documenting everything from day one so no worries there, but I have to say I am not keen on giving it back to them for several reasons, primarily because I have just told them I'm going to take legal action - if I then ring them back the next day and say actually nah I'll just do what you said and bring it back in for repair, then that is just going to make them think they can get away with anything because I wont take it any further. Also, they gave me a terrible service before when I was polite and patient with them, they are going to give me even worse service now that I have threatened them with legal action and argued with them.
I thought you were saying before that you would have taken legal action weeks ago and that I needed to man up and stand my ground, now you say I should just do what they want?

I do personally think that you should stand your ground , i would.

But that is only my opinion and how i would do things , i did say that " If it was a used car lot , then yes you have the 90 days , but this is to correct any issues you have with the car , not a refund."

But that was before they once again returned it with faults , yes i would go down the legal route , but not with CAB i would personally have my solicitor write to them explaining and details the situation.

The reason i kept asking who the dealer was as i assumed it was an Audi dealer , therefor One letter from a solicitor to Audi UK and that will of done the trick , no doubt.

But now seeing there site and reading this >

True, and having been at the 'other end' of selling and supporting, some customers demands are totally unrealistic. If you gave them everything they wanted, you would soon find yourself living in a cardboard box. But what I would say is that if you are planning on making a stand that could result in them escorting you off of the premises, then get the press involved. A car dealer like this could ill afford the potential negative publicity that would come their way.

I've never liked these 'mid sized dealers'. I've always felt safer buying from a main dealer, or privately, where you will have more money left in your pocket to put things right if there are any problems.

Chris, I would be taking as much free consumer advice as I could get before lining some brief's pocket, which as Pete has pointed out could leave you in a far worse position. The calm approach is far better than 'kicking off', so keep it up and don't let them grind you down. Have you done much research online? There are legal forums out there you could try for help too.

I agree, its not the best thing to do, and probably from reading more into this particular instance, Will no doubt inflame this issue more so. Which will get you probably more on the wrong side than good with these cowboys.

However in my particular scenario, I had just bought a near new 740 AC BMW. So I spent a fair few bob and had problems that should never have even occured, let alone fob me off when i confronted them with my problems. And in the end I got what I paid for, which was what I should have got in the first place.

Seems that to conform to South Yorkshire Trading Standards they need to have a formal complaints framework in place.

Ask to speak to their nominated complaints advisor...

"A senior person will be nominated within each member organisation, to have overall responsibility for customer complaints. If employees cannot deal with complaints, the case is to be given to the nominated person. Details of the nominated person will be displayed on the premises and given to the consumer where necessary."

I think I will give them a ring tomorrow and tell them that they have got one last chance to sort it out and that I want them to sign a document that admits to the problems with the car and states that they will be fixed in the next 2 weeks. At least then I have got something solid if it does go to court (I'll be honest, I'm pretty sure they wont fix everything if I do give it back to them).

The garage is owned by Eric and Jacqueline Smith if that helps? Might be worth speaking to him if you haven't.

Fully agreed with the other comment - if the website has "Trading Standards Approved" stamped all over it, and they've sold you a faulty car that they can't fix, then well worth a call to Trading Standards. They're generally useless, and don't like to do much more work than send a letter, but if the garage is part of a scheme, then there might be a bit more they can do.
 
Well I called the garage back just now and said that I was willing to let them try to repair it one more time if they signed a document stating exactly what the problems were and how long it would take them to fix them... but they said "we cant put a time on fixing an intermittent problem" so I said fair enough but a lot of the problems are not intermittent. So as usual they are going to get someone else to give me a call back later today to arrange it, which I bet they dont do...

I dont think that the fact you brought from an independent really makes any odds. i brought my A3 from Guildford Audi and apart from the non returned calls and appalling communications, i have a car that runs like a Dog ! revs itself up and almost stalls repeatedly now when cold, misfires and shunts below 2k revs and Audi have basically washed their hands of it saying that if there is no fault code there is no problem !! They have even put it in writing now that the fact that it pops and bangs when trying to hold steady revs is just the nature of the engine !!!. at 40k miles i now have a pretty useless car that cant be relied on and it will have to go. It is without doubt the worst car I have ever owned and i think the attitude of Audi is almost criminal in their refusal to except there is a problem when i have to worry about whether i will get the 6 miles too and from work every day.

Stick with it mate but it sounds to me like your clutch has gone (Engine revving too high and then coming back down under hard acceleration) so make sure that is fixed if nothing else. Then sell it !
 
god paddy that sounds awful, I thought I had it bad!

I took the car back to the dealer today but they refused to sign anything stating how long the repairs would take... I asked why and they just said "we wont sign it" so I said well ok but thats not a reason is it, why wont you sign it? "because we wont". OK.... its like arguing with a baby. Also, I rang them a couple of days ago to ask them to make sure they had the details of what they replaced last time to try to repair the problems, for me to pick up when I came and dropped the car off today (they said they would send me the details a week ago but never did) but surprise surprise when I got there they had not got the details. They said they would just put everything together and give it all to me when they return the car this time.

Oh and to top it off, I got an even worse courtesy car this time - a 1.6 litre Vauxhall Meriva, which is possibly the slowest thing I've ever driven. Nice one.

I'm just going to have to see what state the car is in when they return it and if its not all fixed this time then I am definitely taking legal action.
 
I think I know the rough area the place is! Got relatives in Donnie, Cusworth & Barnsley (sometimes Stainford when the 'neighbours' are in jail).

From the some of symptoms I think they know whats wrong & how much they will cost to repair (cylinder head cracked & dual mass flywheel worn???) hence why they are dragging their feet.
 
That was my thinking with the clutch Khufu............its just too expensive for them to do the job properly.

They mentioned today that they were thinking of replacing the dual mass flywheel this week - whether they actually will or not I dont know..
 
Sorry to hear about your problems Chris.. When I got a '57 Corsa last year the engine would randomally cut out with no reason, a scan at the dealers shows nothing, so like Pete, they said "No fault found, no fault had", They wouldn't even sit in the car with me whilst I drove it to show them... I know the pain and stress it causes, especially when the dealer doesn't comply.

I dealt with Trading Standards and when they got in touch with the car dealer, I got a call within the hour offering a full repair.. since then the car was fixed, was still a crap car, but it was fixed.

Trading Standards were absoloutly fantastic, can't put a word wrong about them. Simply called them up and they took all the info... what car it was, mileage, faults and info about the dealer. They then gave a case reference number and said that they would be in touch. The next people to be in touch was the garage offering to have the car for a day to test it and then repair it.

Thanks jb0o that is encouraging to hear - I thought they would not do a lot if I went to them (it hasnt come to that yet though).

Latest update anyway: They called me today to say that they have finished repairing it and will deliver it back to me tomorrow. HOWEVER, they said they have not fixed the cd player volume button/knob because it is supposed to be like that. I'm 99% sure it is not supposed to be sunk into the unit anywhere near as far as it is, because its very hard to change the volume with it like it is now and I've seen images on google of other people's that do not have the knob stuck in the unit, for example: http://i12.photobucket.com/albums/a234/mitx/CarPC/Audi_A3-12_800.jpg that is exactly the same as mine except the knob that sticks out on the left (volume control) is depressed into the unit so that there is barely anything for you to actually grip to turn it. I told the dealer this and they said "well on some models it is like that but on this particular model it is supposed to be that far into the unit" and I was just like wtf why the hell would they change JUST THAT on the CD player between different models of the A3 - why the hell would they change it at all when it makes it nearly impossible to turn the knob... Anyway, they said the engineer that looked at will be coming to deliver the car to me tomorrow so I could discuss it with him, fat lot of use that will be.
I then asked about the service booklet (which I requested nearly 2 months ago when I realised it did not come with the car) and was told that I would need to speak to someone else tomorrow, so I will do that but I know they will have done absolutely nothing to get it or replace it. Still, they say they have replaced the flywheel, the clutch, the jet for the rear washer and also some engine part that was leaking the engine coolant, so when I get it back tomorrow I will see if these things have actually fixed the problems this time!
 
Sounds promising , although a delivery to you sounds a little " drop it off with him " rather than let him collect it and make a fuss.
Fingers crossed for you though.

Maybe tell them that you are going to get a second opinion on the volume button , drop into Audi main dealer and ask service to pop out and have a look to tell you if its normal ( act as if you will be buying one if not )

Something along the lines of..

" i am a little concerned about the radio in my car and am wondering if it's broken or if it is meant to like that , it's just i think i may need to buy a new one from you guys would you mind giving me your professional opinion"

If they confirm your views ( which i am sure you know the answer ) , then can they provide a written quote.

They will simple get a price from parts , or ask you to and add a silly labour charge , at least if you get this from Audi you can produce it to your car pitch.

What can they say to that? after all Audi made the ****** car ! , i am sure they know if the button is broken or not.

Worst case get Audi to look at it , if they confirm its broken , but are not forthcoming with a letter at least you can say " well Audi say its not meant to be like that"

Just one question, I assume the car was advertised and sold to you on the premise of it having a service history? If so, then by virtue of the fact they cannot prove it (by not providing the service book) then you have a VERY good case to take it back and receive a full refund, the law and trading standards are very clear on that point alone, you were mis-sold the vehicle.

You really need to heed the advice being given to you by everybody here, contact Trading Standards and explain everything, they will advise you and help you. Surely you would rather get a full refund and be rid of these monkies for good?? I agree with Crypric in that I think you need to stand up to them, with the law behind you if that helps, and get what you should rightfully have.

If you dont then you not only let yourself down, but they will continue mugging other people off in the future knowing they can get away with it.
 
Yeah dont worry after what has happened today I am certainly done with being nice and reasonable... they delivered the car back to me today at work (without the service book or list of work done of course) and when I drove it home tonight I heard a strange swishing sound and then a big bang. I pulled over and looked under the car and saw this big thing hanging down from the car onto the road! I had no way of getting it off and no idea what it was so I had to call the AA who took about an hour to get there because of the snow. Anyway, I drove around the car park of the pub that I had pulled over at while I was waiting for the AA and the thing snapped off - I thought I may as well still wait for the AA though just for them to check and see if anything else obvious was broken. The 'thing' that snapped off was the belly pan, just a big sheet of plastic basically, but it could have easily snapped off while I was driving and caused an accident.

and to top it all off, one of the headlights doesnt work either now! It also still feels quite juddery at idle but I dont know if thats just me... I wouldnt be surprised if the coolant starts running out again over the next couple of days either. Going to ring the dealer tomorrow and also speak to trading standards as this is getting ridiculous - I dont want to just sell the car because I'll probably get about a grand less than I paid for it and why should I loose a thousand pounds of my money just for having that car for 12 weeks (especially as about 6 of those weeks I have been driving courtesy cars!)
 
They still havent called me back to arrange a date/time to fit the replacement belly pan and headlight (nearly a week since I reported that to them now) and of course still have not sent me any record of anything they have done or the service booklet... so I've submitted a complaint to Trading Standards and Consumer Direct and will see what they advise.

I agree i think enough is enough , i have kept an eye on your thread and it's just sods law that it did not fall off when they where on the way dropping it of , ( maybe it did and they pushed it back under )

They sound completely useless and a complete cowboy operation.

I just know after reading all the problems you have had that you will get a result , chin up and keep going.
 
Latest problem: the garage replaced the 2 front tyres a month ago to cure the steering wheel wobble problem but I have now found that one of the front tyres is pretty flat (16 psi) and the other is nearly twice the recommended pressure! It was over 50 psi... no wonder it was pulling to the left a bit if the left tyre was less than half the pressure of the right! Consumer Direct called me back on Friday but I was tied up at work so will give them a call back when I finish today and see what they say.
