Court summons for speeding.... ******

Hi all

I was caught doing 97mph on the M40 back in October. I certainly do not make a habit of driving that fast, it was a stupid mistake to say the least.

Anyway I've received a court summons today for the end of April and wish to plead guilty by post..... Ive done a fair amount of research on this and have read a lot of comments on people advising that its best to physically turn up on the day although i haven't heard of much evidence on how this can help.

Obviously i don't want a ban if it even comes to that but i was wondering if anyone has been summoned for similar offences recently and what they got for it, and if anyone else has pleaded guilty by post.

I will also be writing a strong letter of mitigation stating i need my licence for a multitude of reasons which is truthful. Although i take full responsibility for this i obviously wish for the least damaging outcome.I don't have any points currently.
 
I had to go to court , solicitor told me if I did not appea the case would get a new date for me to attend . That's in Scotland so could be different . If there is a chance you are going to be banned you have to be there I was told .
 
yeah I've heard that too, but theres nothing on the summons saying i must be there. surely they would just be wasting their own time in giving me the option to plead guilty by post, if intact they do want me to come in anyway
 
Mine was years ago , I think if you have the option to plead by post that's a fairly good indication they are not looking at a ban ..
 
Yeah , solicitor was good , he worded it a lot better than me for sure ...

Hope you get a good outcome , I got fined more for speeding than the women up before me who smuggled drugs into Aberdeen prison in her trainers !

The amount of times I've driven the M40 and hardly ever see the police. The average speed on that road is 90mph!

Hope your outcome is not too painful.
 
tell me about it! was by a mobile camera onto of a bridge by Oxford on a sunday morning. fingers crossed its not too bad

I'm sure you only go to court if you already have 9 points and plead to keep your licence, or you just try and get out of it altogether!

Since your under 30mph over the speed limit you have the choice of postal plee, which if your lucky will be 3 points and £60 fine, if your unlucky 5 points and bigger fine, I wouldn't go to court!

When I got caught for a motoring offence it said on the letter if you plead guilty by post you get a lesser penalty, but if you went to court and contested it and still got found guilty you get a harsher penalty!
 
if it was a simple speeding it would be 3 points plus fine.
as its 97 that's the reason its in court.

you will prob get 6 points plus fine could be 500 or a grand.

if your there and its a ban then you can say your part like you could use your job etc etc. this can work in some cases if your not there then you don't have this chance.

and as for your mitigation you don't have any at all you was doing 97 no excuse and the mag wont take kindly to any sort of excuse.
just stick your hands up say sorry and you have learnt your lesson.
 
if theres a chance ill loose my licence they will call me back into court and do it face to face. they cant do that without me being present.

a letter of mitigation is telling them about potentially loosing your job and the wider impact its going to have on you, thats exactly why they advise you to write one if your pleading guilty by post.

"What is a plea in mitigation?

  1. As part of the plea in mitigation, you may explain why you committed the offence and tell the court about your background and personal circumstances. You can also say something about the sentence that the court could impose."

Ive certainly not tried to make any excuses for my speeding, it was a stupid mistake simple as that, and what i get is fully deserved, but i think your slightly misinformed.
 
yes they can ban you without been present .

yes I ment the part explain why you committed the offence

I got a 6 weeks ban in October for 91 on the M1 I pled by post they didn't invite me back for a face to face ban.
 
Really... thats something I've not heard of.

6 weeks ban for doing 91 seems very extreme.... were there any other circumstances? from what I've read the max ban i should get is 30days.
 
Is it your first speeding offence? I can't see you getting banned at all, I thought 30mph over the speed limit was a ban, but might be wrong probably depends on different police forces and courts
 
its my first offence in 6 years so currently have a clean licence, i believe thats classed as my first offence?
 
Ye I would say so, it could happen to any of us mate I'm like a hawk looking for them mobile vans they are everywhere these days, anyway no point worrying expect the worst hope for the best and let us know how you get on!

was a clean licence plus I'm a ADR HGV driver.

but in 2009 I got 59 in a 50 on the M50 6 points and fine.

2004 same spot M50 103 in the 50 4 weeks ban £1070 fine
I turned up for that one.

licence was clean on each one
 
yep 6 points then same court a few years before 53 over and only a 4 week ban.
 
That's nuts! I only got an 8 week ban for 128mph. My friend who I was in convoy with got 4 weeks.

Oddly insurance companies couldn't seem to have cared less about it with no rise in premium across any of the policies I hold or am named on.

Hope you get a fair outcome

When was this? I think things are much different these days, as courts like to make an example! I think you got lucky there. I got 6 points and a £350 fine(reduced to £250 using a traffic solicitor which cost me £150) for doing 59 in a 30! It was made very clear to me that had it been 60+ in a 30, it was an instant ban, and that I was a lucky boy!
 
I've pleaded guilty by post twice and got hammered both times! Better to go there I person imho as it at least shows you've made an effort.

One of mine was 55 in a 30 though although in my defence it was a 2 lane road albeit not DC!

so it actually cost you more, lol.
 
I got caught doing 62 in a 30! it was a bad decision and one I wont be making a habit. I appointed a solicitor to take me through the process which lead to hiring a barrister on the court day to represent me to try and minimise my penalty. Was it worth the extra cost? I don't know. The court did not impose a ban. Instead I had 6 penalty points imposed and had to pay a fine. The whole experience cost me in the region of GBP 3,000 and that does not take into account the potential increase in insurance premium at future renewals. It is expensive, but it means that I kept my job which in the grand scheme of things if the most important thing. It was an expensive mistake, but has knocked me down a few pegs and hopefully has improved my awareness. Knowing that I have 6 points on my licence now (previously 14+ years with zero points) has slowed me right down in the fear of totting up and then losing my licence.

The judge said I was lucky and that the character references I supplied helped her come to the decision she did. All evidence produced was on the back of the solicitors advise.

Slater and Gordon was the firm I used. I think they are national and have a motor specialist division.

I know I have opened myself to some criticism on a public forum, but if it helps others, then so be it!

Nothing to criticise about, you just have to admit your mistake and get on with life.

I totally know where you are coming from regarding slowing right down though. I was as clean as a whistle like yourself prior to my 6 points. its the thought of accidently getting another 3 points, and then you are just 3 points from a ban! Once those 6 points disappear, you will feel a burden off your shoulders. Trust me. ;)
