Car damaged while at Audi garage

Just had a phone call from the Audi garage in ayr.my car was in to get a fix on some wind noise under warranty...they just told me a customer has hit my car on the front I’m waiting on pictures getting sent to me

They said they have to claim the persons insurance and will get it booked into there body shop as soon as they can but now I feel I no longer want the car any advice welcome on how best to go about this....will post pics when they send them
 
First of all, them claiming the other person's insurance is none of your concern. They are responsible for your car whilst it's in their care. If you check your own insurance policy you'll see there is a reference to your car being in the care of a garage etc. So don't worry about anything insurance related. The dealer will put your car right straight away without having to wait on any insurance related stuff from the third party. If they say otherwise then be very firm with them and complain to Audi UK straight away.

You "no longer wanting the car" is a bit extreme and if this had happened anywhere else than the dealership you would have no choice but to have it repaired as is the norm. You have no grounds to reject the car or get rid of it just because a third party has hit it. What if you were driving the car out of the dealership at the time and another customer hit you? Would you be marching into the showroom demanding a new one?

It's important to remember that cars are modular. A bit like a house. You don't go get a new one if some of your roof tiles fall off. You just get it fixed. Unless the damage is catastrophic, there's no reason why it wouldn't be good as new when you get it back.

Just wait and see what the damage is first, could only be a love bite.
Understand it’s annoying and you leave your pride and joy with a dealership for this to happen but seems a bit extreme you don’t want the car anymore mate.

Looks a bit nasty but at least Audi will change every panel for new ones and bill the other persons insurance company for the privilege.
Can not see them trying to do any smart repairs on this
 
Gutted for you fella. Imho take it to a garage you trust to get it repaired well and insist / agree with Audi that they pay for it. Imho Audi will try to repair it on the cheap.

Edit - just to add that this is why I park at the back of any / all car parks! Most people are total twunts and don't give a flying **** about anything incl nice motors. Appreciate that the OP had no say in where his car was parked unfortunately.

New wing, new bumper and paint. It'll genuinely look as good as new. Much as I agree with you about not wanting a car with repairs on it, it's only a wing and a bumper - it's not like it's a rear arch where the bodywork goes into the roof etc.

A new pair of tyres on the front wouldn't go amiss either lol :whistle2:.

That'll get fixed up right as rain in no time. I'd go down and have a chat and then push them heavily. You want them to repair it and the warranty for the repairs to lie with them if theirs any problems and you want some goodwill for the inconvenience. If they try to pass off the responsibility to the customer then I'd be saying thats irrelevant and that it was in their care.

Damage looks nasty but looks like you'll have to let them repair it and get on with life. Not great but not much else you can do.

Went down to see them at the dealership...gutted to see it damaged ..they are saying it must go through the other customers insurance..I wasn’t happy with the fact the car was under there care at the time and surely shouldn’t have been in a position to get damaged surely the only way it should have been damaged is by a employee working on it ??


The car was booked in for any paint to be corrected and full ceramic coating starting on Sunday paint windows wheels and calipers

Haha ........yeah pretty much mate but just hoping the repair is unnoticeable
 
Not sure if it’s just the picture but the wheel looks to have been caught as well?

I’d insist they use new parts & not a smart repair , tell them you want to see the old parts they’ve taken off including the bumper etc, I only say that as I had a similar issue & they used a smart repair guy & I refused to accept the car until they replaced the bumper & wing for a new one

Funny enough just been informed of a close family member who has suffered less .
 
How it came to be damaged on their site is irrelevant. It was in their care and so they're liable. They can, in-turn claim the other customer's insurance to reclaim their own costs but that shouldn't have any effect on you what-so-ever.

This is totally what my out look on it is but they are still saying because it was a customer car that hit mine it’s there insurance....I said to them that I feel it should be them fixing it and then claiming the customers insurance but they disagreed

Going to try get some legal advice on who legally is responsible for the car when in the dealership.

My argument is that a car in getting work done should never be in a position to have a customer car hit it if I was in and having a look around at cars for sale then yes I’d agree with them but when they are in possession of my car then they should have a duty of care to make sure it’s looked after
 
No grounds for rejection. That’s a very extreme viewpoint and you would likely be carted off to a lunatic asylum for even suggesting that. It’s a minor inconvenience that’s all. Audi will sort it no problem and I would only go with Audi for the repairs personally.

Audi have hundreds of cars that pass through their dealership on a weekly basis, they can’t be expected to wrap every car up in cotton wool. The old saying of sh*t happens rings true, could have happened to anyone anywhere, just relax and don’t let it stress you.

The only point I would be pi*sed off is the delay in getting the other insurance details. I’d demand they fix it as soon as possible and recoup their costs later. Rather than wasting a week or 2 before the insurance liability is confirmed.

Whether it was in a position to be hit by a customer is immaterial. Lots of dealerships have areas where cars awaking to work or waiting to be moved are in communal areas. That really has nothing to do with it. The argument is that the car was in their care and was damaged. They are the third party in this case, not their customer. They will have their own public liability insurance policy. If it's a lower minion you're talking to then they may be ignorant of the facts. If it's someone senior enough to know better then they're trying it on.

This is not like you're car was parked at Asda and another customer hit it and Asda caught them. They were responsible for your car. It's not like parking at owners risk in a public car park. I'd ask to speak to the Service Manager and go from there.

Even some new cars will have been repaired and the buyer will never know.

As an indication of cost I grazed the garage wall and it slightly scratched the paint with no metal damage.

Kindertons called me to just before office hours close to say they will call tomorrow morning to start the claim process so hopefully shouldn’t be long and just checked my emails and Audi said they have sent the pics away to there body shop to get a quote so hopefully it can be all sorted out quickly as the other person has said it was there fault etc

Well my plan was to see what the proposed repair is and send it on to the detailer mjm who I had booked to ceramic coat the car on Sunday and see what he thinks to the proposed work and when it’s done have him look over it and see if it’s up to standard

No no offers of a sweetener or anything but I will ask as it’s cost me some hassle to be fair and proper p’d me off

The question is what they expect you to do now? Are they saying that you need to deal with the insurance claim aspects or are the doing it? If they're doing it then it doesn't really matter. But if they expect you to do it then thats a different story.
 
Not sure if it’s just the picture but the wheel looks to have been caught as well?

Eagle eye sir...I called the dealership they went to inspect the wheel there is a bit of a mark and said they will get on to there Bodyshop but for me it has to be a new wheel as refurbishing one wheel never matched the others

I'd have thought that their public liability insurance would covered this but it seems that you would need to prove that the dealership failed in their duty of care. Short of you having witnesses saying they left it parked in the middle of the road with all the doors hanging open, I think you'll just need to get on with it.

I think they should offer something because a car that someone pays money for each month was left in there care and it’s not been returned in the same state it was given to them.....but If it takes a month or two to fix then I’m paying payments for a car that’s damaged

No the dealer has sent pics to there body shop for a quote for the fix but still not certain that it will go to Audi for the fix as I don’t know if the 3rd party’s insurer will want to send it to a place that they want

If without the car unreasonable amount of time I’d say that’s fair, they should provide a courtesy car at least. Accidents do happen though, just as they could happen to us whilst we are driving.

Well I’ve refused to take the car away from the dealership as I won’t drive a car that’s damaged like that if I had hit something it would have been booked in somewhere or already getting worked on by now....yeah accidents do happen whilst we are driving...but shouldnt when in a dealership getting warranty work carried out
