034 word of warning

034 motorsports, My Performance Parts and Awesome GTI- buyer beware, if out of spec you’ll be out of pocket.
So I bought an 034 rear arb for the SQ5 from My Performance Parts via awesome gti as their official importer.. It was out of spec and I ended up out of packet by £109. Originally £159 and eventually managed to get £50 goodwill which is crap.
It turned up and was labelled correctly, all signals said it was the right part, looked right, was only when they tried to fit it they couldn’t.
The brackets welded on the bar were in the wrong place (despite having a quality control signature and date on it - obviously by someone who couldn’t give a ****) but not noticeable visually.
My garage took mine off, tried to fit it, and couldn’t, so had to refit my original one and get new bolts to do so otherwise I’d have no car. Tbh they spent longer on it than they charged me for as I’ve used them for all my cars over the years.
I flagged this issue to My Performance Parts, they washed their hands of it pointing to 034, so I spoke to them and they washed their hands saying my contract was with who I bought it off not them.
Speaking to MPP they said they can only refund it 034 do so I was stuck in a crap position.
eventually MPP offered me £50 goodwill vs the labour and parts £159 I’d incurred for them selling me something which they agreed was out of spec. I took it as had no other option, and even then had to spend 6months chasing that payment as well.
So through absolutely no fault of my own, buying a part which had quality control signature and approval, only appeared out of spec when we tried to fit it, I got stung for the labour because they waived all responsibility as their T&C’s said they cover labour. I get that if I tried to fit the wrong part, but their part wasn’t fit for what they sold it for.
Be very very cautious and I would never buy from them again (I’ve had Audis for years and bought a lot of 034 products).
Shame as since fitting it the ride is so much better and no wallowing. But the whole buying chain of no one accepting responsibility tarnishes it all. SHOP ELSEWHERE!

@razza1 , check your rights under the Distance Selling Regulations. Your contract is with the retailer who sold the goods, not the original manufacturer. Where goods are unfit for purpose or not as described, it’s my understanding that you are entitled to a full refund .
 
Also, if you paid by credit card, you can raise a dispute through the card provider under S.75 of the Consumer Credit Act 1974. If you paid using Paypal, a S.75 claim is not an option, even if the Paypal transaction was funded from a credit card. But you can raise a dispute through Paypal. Don’t write your money off until every avenue has been pursued.
 
Small claims court :icon thumright: You can do it all online and costs IIRC £35 which you'll get back plus interest if they find in your favour. Obviously then you'll have to chase them to pay but they'll have a CCJ against them until they do.
