Tyres, Quattro, diffs, advice needed.

Had a slight drama today when I got a blowout. But I'll start this story when I bought the car two months ago.

It had quite worn but legal and even wear on 3 x Pirelli P7's and a brand new Falcon on driver front.

When I went to kwik fit after blowout on passenger front (yes I know but i live in countryside and need car sorted for a drive tomorrow and no one else open), they refused to only fit one quoting that on quattro the tyres have to be axle matched by wear and tread pattern and also be within 2mm of rears or it can cause diff problems and this is Audi's own advice. They said that it leaves them liable on the diff and it's a head office directive.

The question is, given that Audi sold me the car outside of their own guidelines and I've had to get two fitted as kwik fit refused one, do I have a case to go back to Audi dealer and get them to pay for 2nd one?

Any thoughts?
 
(I have kept the Falcan and will order one online so as to axel match on back when the two p7's are finally gone shortly)
 
Taken from page 380 of my manual:
"On vehicles with four-wheel drive, all four wheels must always be fitted with tyres of the same type, make and tread pattern, as the driveline could otherwise be damaged by variations in the wheel speeds. For the same reason, only use a spare wheel* which has the same rolling circum-ference as the normal road wheels."

I'm not sure whether you'd be able to "claim" back off Audi for selling it you like that, as ultimately you purchased and accepted the car.
However when I had to get one replaced, they said that there was some (?) tolerance between tread on either side (albeit small). I'm guessing as the front driver was brand new, and the front passenger blew out, that the replacement passenger would have been very close to the drivers side anyway? I'm surprised they didn't ask you to change both the rears too, as they would be different to the fronts.
If they forced you to change a reasonably good tyre with plenty of tread left on it, then personally I'd have kept the tyre myself as a spare for the future, or sold as a part-worn.

I have kept the good one and I'm going to order another the same as to match the back axle when the p7's on there are finished in a few more months.
