Need advice !!! car replacement

Right guys some of you may know the saga i have been having with Audi since i had my new s3 back in December,

Long story short my s3 has a serious issue and after the 4th time of it going wrong i handed the car back in febuary. Here is a previous thread that explains all.

North wales Audi and Audi UK agreed to get me a replacement and up until the replacement my payments would remain in place.

So the time has come where im about to receive my new car and Audi have said that its a new car so a new agreement,

Now i have had a settlement figure on the S3 i had issues with and handed back in February 27k.

Now Audi have said and i quote (new car new agreement) ie ive been paying for a car that i have not had , had issues from literally day one to be told quite literally it was for nothing and that the new car will start from its new price,

Now in my eyes this is bang out of order but id like some opinions on this, its not my fault that my original car was not fit for purpose other i would not be in this predicament .

Yep that is bang out of order. When I spoke about rejection I wasn't led to believe I continue paying on my agreement and the new car arrives, having had paid 6 months finance on it already so you'd have a load of equity!

Fight it, you've basically just bought another car again that way!!

Wow, does your dealership think you cant add up.

Its like paying a mortgage and not being able to live in the house because the builders screwed it up and made it inhabitable. Recompense is the word I think they need to understand.

All that money i have paid off my car and for what, nothing.

You have paid a premium for a car you didn't buy the last few months and now they tell you that all money paid to date has been on a problem and that's your fault.

They should have told you in the first place, all you've done is sell the S3 and buy another... that's not how rejection works!!
 
I agree with you but you have clearly agreed to something as you have a new car to collect...

If it were me, I would have negotiaited payments/terms before I let them offer/order me a new car and certainly before I collected one.

My experiance of Audi has been poor and as a first time customer I am dissapointed but thag being said, they are a business and businesses are in existance to make money, not to be generous to customers.

Regardless of my woffle above, it appears unfair and un realistic and if I were you and it was an option, I would speak with the finance company and try to get yourself out of any contract requiring payment for the new or old car. I would then regroup and start again if you so wished. If you chose the new Audi, it would be a new car and new deal.

Why you have been paying for a car you havent had use of, is beyond me.

You should have never been paying for a car you didn't have, they've pulled one over you there.

I'd be looking into contacting the ombudsman etc.

Ost, after the 4th time of my new car breaking they just said they would get me a replacement, nothing more was said.

to date i have spent £3500 down and a total of £2590 of payments, and for this just to be wiped away especially when really i have not had a s3 fit for purpose from them from the beginning.

So angry right now, this saga has been going on since december.

Sounds like your arrangement should've been similar to @mike price above.
ie. any payments you've been making in the interim should've gone against the replacement vehicle and it's debatable if you should be paying now based on a new agreement. Audi should be putting you back in the position you were in prior to the problems happening at no cost to you.

Without knowing what you agreed to I think you need to get some advice on this, the payments should have stopped the moment you returned the car or the payments should be taken off of the new car.

Don't be pushed into this.

Everyone is saying the same. I would ask Audi to provide you with a considered, sensible offer but under no circumstances agree to starting again, I think they are trying to pull a fast one. Also dont forget, 'getting' you a new car will be in their favour as it will be viewed as a sale as far as Audi are concerned!

I think the fair solution would be for a new agreement, with your original figures ie the agreed price for the car, less your original deposit and less any payments made since you returned the S3.

When I had Audi Macclesfield swap my problem A4 for another one (less than 6 months into the agreement), I got them to discount the new car by almost the amount I had already paid into the first one (didn't quite work out, think I ended up around £500 down, but in a car with better spec, so roughly equivalent).

They are having you over a barrel.

well after speaking with Audi finance today the guy i spoke with was totally on my side and was now looking into the case.

I really do believe that North wales Audi are trying to pull yet another fast one.

Will hopefully get a answer tomorrow to what is really going on, im just so fed up right now its horrible, buying a new car is meant to be a enjoyable experience right??

Hopefully if Audi finance are on the case you'll get an outcome you're happy with and a car that will work!

Hope this works out.

The initial post just seemed wrong. End of.

If Audi don't come good - I would be seeking legal advice. Or just take them to the small claims court. The limit is now £10k and it only costs a couple of hundred to apply.
Chances are, if you go ahead and issue proceedings - Audi won't want the hassle and will suddenly come up with a very reasonable offer.

There is a wee bit of a lesson there.....do your dealings with the manufacturer and the finance company not the dealership. In this case both were Audi, which may have been of a benefit. Most finance companies could not care less what has happened to the car, only what you signed as for payment schedules and penalties, etc. for early termination of the agreement.
Also note that manufacturer's finance companies are a totally separate company and are their own profit centre.

But your sales contract is with the supplying dealer and it is they who need to sort this.

Audi Finance will have a big say in it too. They will come to a good agreement somehow I'm sure of it

On returning a car.....Audi will say yes or no after they are assured the dealer has done his bit in fixing faults. plus you keeping Audi abreast of your dissatisfaction in the saga and your intent in returning the car. It is in your best interest to have a very good look at the return contract as far as when the new car is delivered, finance compensation, loaner car etc. ....no word of mouth. if they provide a loaner car, your original finance obligations will remain in force and that is where you have to do some serious negotiations. These are just my thoughts and the situation may be different under UK law.
As an aside Audi North Wales seem to come up quite a bit, as far as service is concerned

I think that's the least he should expect, for the fanny on they've caused I'd be wanting a fairly sizeable good will gesture on top of that.

Hope they have so added extras in there for you to make up for the hassle they've caused. On a brighter note you've managed to pick-up 2 new s3's in under a year, not bad going!

I genuinely wish i did not though, the saga has really taken its toll on me and would never wish this experience anyone.

I had a £150 meal out, a free tank of fuel and a remote control R8 and my order went swimmingly and I'd had a good discount lol, think you definitely deserve something after the ordeal you've had!

which dealership was that Tom?

I ordered through Hitchin, Bedford frustrated me by telling me I could have an extended test drive then when I went to book one changed their mind!

As it happens a young lady I've dealt with on and off for years with the VW's I had is a business manager there, spoke to her and had an S3 Sportback sorted for a couple of hours within half an hour (and she was on annual leave!)

Christ, what a truly miserable experience. Forget original deal for the car, I'd be expecting the ruddy car for free with the amount of hassle/stress/misery you've experienced.

Wow you lucky sod!! I had an umbrella and a carbon mug. I know with the crap experience I've had with my dealer so far, they appear to refuse to go the extra mile or even do the full mile.. so I don't expect much, if anything. I will be asking for a gift if I don't get one offered.
