Pulled into a car parking space.

car to the left didn’t look when opening door, door flew open straight into the side of the car.

other car owner would not give details and said they were going to claim on my insurance as i have drove into their door. Which is incorrect.... you have slammed the edge of your door into my slowly moving car (which has cause quite a mess)

as they would not give details i have claimed on my insurance and they are going to chase the other driver.

now i am not very hopefull for a positive outcome and i feel the insurance companies will go 50:50 split fault.

what do you think my chances are? Obviously i have to pay my excess up front and will lose my no claims unless the claim is judged in my favour and they will re-imburse me.

in my mind it seems pretty obvious they have opened their door in the path of my car but like i say i’m sceptical that they might just choose easy 50:50 decision? Like if i drove into her car as she claims surely i would of hit her door with the leading edge of my front bumper not the middle of my passenger front door? And it has obviously crippled her yaris door? The impact was the edge of an open door but obviously has rippled down to the edge where the door connects to the car.

The photos of you door do show what appears to be damage incurred by something opening onto/hitting it, but I'm confused. The damage to the red Yaris is at the hinge end. Yes, as you say this could be due to the door rippling but damage on the front end shows a chopped edge. Also why no picture of where the Yaris door hit your door. I think that is what the insurance company would want.
I'm a numpty and not dealing with insurance claims as a job and can see gaps in the "evidence". As you have no eye witness accounts I would think your chances of getting anything out of the Yaris driver are slim.

I work in Insurance claims litigation
I take other insurance companies to court if they fail to pay claims, I am very well versed in motor accidents, I have been doing it for 20 years.

I can tell you from the damage 100% you are not at fault, and if your insurance company tries to say 50/50 after seeing both sets of damage then they are fobbing you off.

Cause the missus was driving and thats the only photo she took. I did ask where was the zoomed out image.

i think the other driver took advantage of her and made her think it was her fault.

the yaris door is rippled like that i guess cause it’s made out of old coke cans / sardine tins i think, and the damaged part at the front edge of the door i would think would maybe of came from the door check strap as when impact occured the door was open so has been pushed into that or something in that area.

I know and you know that it’s 100% the other driver at fault throwing a door open without looking, if the door was open and my missus had drove into it the damage would of been on my front bumper and with the angle that would of hit at would probably of taken the yaris’s door clean off its hinges.

but as its hit my passenger door just before the handle that indicates to me the nose and wing mirror of my car were passed her car before she swung the edge of the door open into my car.

thats my judgement though
 
One problem you are going to have is not having a picture of the other side of the door.
Like Eriba said, I cannot see how the end door panel is damaged like that, but on the other hand it would be impossible for your partner to open her door into the third party and cause the damage on your car.

Is your partner saying the third party corner door flew open and hit the side of your vehicle? If so the damage by the wing mirror would not be as a result of this action.

Please take into account your policy excess, possible loss of NCD and 3 years worth of premium increses compared to fixing the damage yourself.

You may see your premiums go up by £50.00 next year, or could be double depending if you lose your no claims.

Just reporting the accident to your insurer and not even claiming will rate on your renewal as they will put it down as a non fault claim regardless if you claim or not

There is no damage to my wing mirror only damage is my door.

i guess she hasnt taken a picture of the edge of the yaris door as other than the red paint transfer to my car there is no damage on what would of been the open edge of the door this would be double skinned and pretty solid. The shock has transferred down the yaris door and crumpled it at the weakest point, like crumpling a coke can the middle goes before the end.

As the Audi moved forward, the Yaris door opened, it then 'connected' with the door of the Audi, and as the Audi continued to move forward the energy directed itself back down the Red cars door and caused a crease at its stress point, forcing the door past its stop catch.

A Yaris has very light doors!

She must have had it open at full extension though, so the question would be asked that the Yaris's door looks like it was already open when the Audi came in to catch the end and force it back.

Its an odd one, basically the Yaris owner hasn’t looked in the side mirror and just hopped out not expecting a car to be arriving. I think ultimately though the blame lies with the yaris owner, but i can also see how an insurance company could choose 50/50,

if the door was open before the audi arrives then the audi hits the yaris door with the bumper not the passenger door, also there is no damage to the audi wing mirror so the yaris door must be opening after the nose / mirror of the audi gets past.

its an unfortunate circumstance and i feel sorry for the other half as the yaris owner has made her feel at fault.
 
Whatever the outcome i am fighting this one tooth and nail.

the fact the yaris driver also would not give details admits guilt in my eyes

My door is screwed though, right on the swage line, pictures don’t really show how bad it is, also lower to the image the bottom of the door has popped out, i think it’s a complete new door job, don’t think it will be salvageable.

Do you not have a dashcam, they are only like £50,00 for a decent one. My partners has been going for 4 years now and its got great video, this would have shown the third party vehicle door was not open when your partner approached.

The third party is going to claim her door was already open and you ran into it, and based on your sketch and damage and knowing the whole thing now, it will not be able to be diproved so yes it will go 50/50, but you dont know what they are going to say right now, but prepare for the worst. 50/50

I am already prepared for 50/50, i understand i will most likely get shafted. I will fight it to the death though. 100%

The 15 y/o Yaris will be a write off i only took it the insurance route as thats what the other party threatened. **** em

I guess how one defines an accident would mitigate that requirement. Generally a motoring 'accident' is defined as hurt being incurred by another person. So @Bigjase88 could claim whiplash:welcoming:

i have been back down today and although on a high street there are no CCTV cameras anywhere to be seen, been in and asked the shops and nothing that views the carpark.

my insurance company believe it is no fault on my side of things as do the courtesy car company so they are looking to put blame onto the other driver. The person i spoke to said from the location of damage to both vehicles it would almost certainly go in my favour.

which is good to hear.

That is good positive news, although it depends on how strongly your insurance company are willing to argue and pursue the case.

Lets hope so as i have 10 years NCB banking on it.

should probably of protected my No Claims, guess thats hindsight.

may just buy a dash cam right now for any future mishaps
 
Even with a no fault claim and no claims bonus, they still put your insurance up the following year, because of it.

Insurance is a racket.

Yeah i know they did that last time when my pal reversed into me.

they halved my NCB as it was seen as a claim but a non fault claim.

its farcical.

a claim is a claim fault or no fault. At fault you lose entire bonus, not at fault they half it / take a couple years off. Con-men

I would totally recommend this.
I have had one on my 3 previous cars and it was a neat and simple installation by pluggin into the 12v outlet at the front(back) of the centre console, but my present car will require hardwiring into the fuse box which is a little more tricky and I have not got round to yet.

I would like to hard wire one if possible i hate wires and plugs kicking about!

Yep worth their weight in gold! I was doing 40 in a 40 limit last year and noticed the guy in front kept looking in his mirror!!!! Next second he decided to slam on his breaks for no reason! Luckily I was quick on mine, as was the car behind me! He then drove at 15mph for a few hundred yards and slammed on again! Drove again for a few hundred yards doing 15mph gave me a sign out of the window and booted it never to be seen again. After getting home I uploaded the cam footage and the next day the police contacted me asking for a statement....long story short he got done for it :D

The intact wing mirror is significant info - ensure you have a pic of that.

Dash cams are good and will pick up most things but in this case nothing short of a Tesla / Outlander with 360 degree mode could capture this occurring. All it would show is door was closed as your front near side corner passed the Yaris.

Couldn’t not have front and rear dash-cams in my car now. Shortly after I got the S3, I suffered ‘satsuma strike‘ while cruising down an A road. Some brain-donor decided to defenestrate a full wee orange (intentionally) in my direction while driving in the opposite direction. I saw a lad lean out the rear off-side window and launch something at me, which hit the windscreen with an almighty bang - I ******’ jumped outa my skin.

Thankfully it was just a Victorian stocking filler - but the act of hurling something at my windscreen while they were driving pee’d me off, so I passed on the dash-cam footage (which captured the full act and reg number of the numb nuts) to the local plod, who, fair credit to them - tracked them down and gave them a ‘caution’ for dangerous driving.

It’s an unfortunate truth that our cars sometimes don’t bring out the best response in people...

Well the car is repaired.

new passenger door was required, they had it down as a repair but it could not be repaired so had to get a new door.

Respray seems to incorporate front nearside wing / new front nearside door and rear nearside door. Guessing they had to blend it in, when i collected it the light was failing so i will have to have a better look over the weekend in the day light.

i had to pay my excess and my insurance will look to claim this back from the other car’s insurance. The claim can take 6 months to settle but right now my insurance have it as non fault on my side.

guess we have to wait and see if i can ever reclaim the excess
