Taking a Car Back to the Dealer

    Heres the story....

    My brother just bought a house and has px'd his BMW 318 in at a garage and got a Vauxhall Astra + cash back (needed towards deposit).

    Since he had had the Astra (2days) it has randomally cut the engine out for no reason 3 times, the car stalls when setting off sometimes even though he's got enough revs and a few numerous things like rattles etc..

    He's not happy at all. He phoned the garage who told him to bring the car in and they said they'd have a look. But he doesn't want them to have a look at the car, he wants them to take it back and he'll get another car.

    Where does he stand by this?

    By law can the dealer just say "we'll fix it", or can he take it back within a certain time with a valid reason and ask them to take the car back?

    Sorry about the rant, just feel sorry for the guy :(

    I think it will be more up to how the garage feel, it might be worth asking the question nicely without resorting to legal measures yet. They may say go ahaead so they have time to fix the Astra and sell it when it's fixed

    if buying from a trader your rights are the same as always . however certain factors must be taken into account a car should be fit for use on the road be in a condition that reflects its age and price and be reasonably reliable . sold as seen as no basis in law your sale of goods act rights still apply. you are saying it cuts out therefore it is unfit for use on the road go and tell the trader this although he does have the right to put the problems right

    I think he suspects that the cars gonna be in garaged more than it is used and just wants to come out of it.

    He's taking the car down tomorrow to see what can happen.

    Pretty sure (but not 100%) they can give you the option of repair of replace, but if you opt for repair you can't then change your mind later and have it replaced after it's been repaired.
