Amk engine S3 going into limp mode if driven hard

Hi all

Not posted on here for a long time , I have a AMK engine S3 and i'm having a problem with it
the car drives lovely but if you give it some wellie it goes into limp mode without any CEL lights coming on
and losing loads of boost, the turbo still spools up and you can hear it in the cabin of the car

the only way to sort it is to disconnect the battery for a minutes and then it drives like it should
however only after a short time it reverts back to limpmode

any idea's its completely standard apart from a K&N pannel filter

Scanned for fault codes? sounds leak related...

scanning with my mates VAGcom tomorrow

previous owner said nothing shows up on the scanner

If it goes into limp mode it would have thrown a fault code... previous owner could be telling porkies or just using a generic scanner which doesn't pick up all VAG related codes... a scan with VCDS should show up any codes that were missed
