Facelift Potential Uninsured driver accident

Good afternoon team Audi,


This morning on my way to work....

I turned off a roundabout and about 10 meters from it. I had to stop as there was a car infront of me turning right.

Just as the fiesta infront of me turned, BANG
Ive been rear ended by a guy in a ****** 1 series.

I suspect he came round the roundabout far too quickly and obviously couldnt stop in time.
Probably eager to get a glimpse of the vegas yellow beast (this just confirms it attracts muppets)

So he has hit me at around 25mph under hard braking and the damage on my car just seemed to be some scuffed up paint. (you can even see where the kidney grill on the beamer has kissed it.)

It was a hard bump, but luckily I wasnt hurt or the BMW driver and his passenger!

He was very reluctant to give me any of his insurance details......But did give me his phone number and address etc.

He DID admit liability on 3 seperate occasions aswell!

(I got plenty of pictures too, which of course in the situation is the best thing to do)

He was adament he did not want to go through any insurance company.....I explained that was potentially ok. As I dont have protected no claims at the moment (5years) I also dont fancy being raped by my insurance company come renewal .........especially for something that was not my fault!

So If he could suffice cash to cover the full repairs, it perhaps wouldnt be so bad. Which he said would be fine......

So I had all his contact infomation and plenty of pictures. He apologized again and The we Left.

So i get to work.... and i decided to take off the bumper to have a look at the potential damage underneath.

My findings are that I deffinetley need a new slam panel and bumper bracket! The clips are all shattered along the top aswell as the main supports all the way along.

Its also broken my diffuser and damaged the clips on that too!!
Not to even mention the cosmetic damage.....

So I called Audi and got a headed itemisation of the bits I need for repair.

(EXCLUDING paint and Labour)

It comes to £981.57

So I have a very good body shop near where I live and hes qouted me £500 all in to have the paint and fitting done.


So I let the BMW driver know (sent him the invoice for parts) and said basically

£1500 cash and we shake hands and walk away.....

Its been many hours and I have had no response.......

I still need to go to the policestation to fill out some of the accident reporting forms.

Im wondering If I should text him basically saying......... agree and pay up...
Otherwise I will report you as being unisured and take him to the cleaners (If I can)

But of course I believe in giving people a chance!

What do you think?
 
You definitely should report to your insurance company, even if you don't want to claim. It's the rules.

Go on askMID or whatever it's called with his details & it'll tell you if the car is insured or not.

Totally agree with this. If the BMW driver doesn't have the money to insure his car he certainly won't have £1,500 to fix yours.

People say all sorts of things at the scene of an accident through shock etc. Get the insurance company on the case as soon as possible, you are obliged to notify them anyway, and they can do the legwork and pursue any issues with an uninsured driver if applicable.

Hopefully though he is insured and just being cagey/nervous.

This is awful, you have had the absolute worst of times with this car :'(

I hope you get a resolution, very unfortunate!

OMG you have had some bad luck with that car mate. I wouldn't hesitate, I'd contact my insurance and let them sort it....that's what you have paid YOUR insurance for, if he hasn't paid his then hard luck. What if down the line you find that your cars chassis is bent?

I'd recommend you let insurers know asap, if you delay notifying them they will w at to know why and you don't want to give them reason to be suspicious.

If he is uninsured you claim through the MIB.

But the police won’t be interested. No point in going to them.

I would still go to the police regardless if yjey are interested or not as you HAVE TO REPORT it within 24 hrs .

So you call the police - tell them you had an accident - they say its an insurance matter. And that’s that. Happened to me more than once so there is literally no point.
 
If it's a non injury accident, then you don't need to fill out any police paperwork, unless you haven't exchanged details. I would inform your insurance company, if you don't and they find out, you can be in the **** with them and it may alter your premium.

Don't mess about, just make a claim, it'll come off his policy if he's insured, if not then the MIB will cover it

after my experience a few of years back was I shall never report it to my insurers if it's relatively small.
I did so after some muppet reversed ( wrong way on one way street ! ) into me and the repair bill was about £150 - paint only. He gave me all his details but didn't pay, went around to see him, he had moved out ( private rental - spoke to land lady - no forwarding address) . I did report him to his own insurance company.
I gave up and three months later my insurance company tried to double my renewal premium " because of the accident I had " .
It took weeks of arguing before they caved in !

If MIB cover it do you loose your NCB ? ( see above ! )

The issue is, if you don't inform them and someone else does (the 3rd party as in your case you told his insurance), they can and will try and claim more money from you.
I think the wording on the policy renewals is, "have you had an accident in the last 5 years, regardless of fault", doesn't mention anything about claims.

Update!


After waiting 6 hours, he rang me to discuss the repair. (Surprised he WAS infact insured! )

thanks to those who put me onto the database checker!!!

He noticed my previous damage and was adament he wasnt paying for that. Which i can understand..............but he crashed into me with NO fault of my own And has caused further damage to my car. Which for him meant I needed a new bumper and various bits anyway.
Eventually said He didnt agree that £1500 was a fair price...... trying to offer me £500 !!!!!!!!!!! :rage:

At this Point I have lost my patience and told him I was handing his details to my insurer who will recover the costs from his insurers.

He really didnt want to do that but I said hes given me no choice!


So after Speaking to My insurer They were very glad I reported it and they have taken care of everything!!

I havent lost my no claims and I havent got anything to pay!

I told them about the existing damage too And they said its absolutley fine

Haha worked out well for him then! Good thing is now then mate you'll get your bumper back to 100% thanks to his insurance.

I had to claim once for a non fault accident, after 2 weeks of getting nowhere with the at faults insurer, I called Direct Line and it was all sorted within about 2 hours!

I do find it funny that you get a bright yellow 3 door Audi with 4 exhausts and are surprised it attracted boy racers and attention.... lol
 
Happy to here you got a Result , and as for the car us yellow pearl owners need to stick together he he plus it is the 2nd best colour that Audi did the S3 in and the 1st has got to be the Green but hard to find these days
 
I just knew it would be you when I read the title!

Glad it's all sorted, these things happen unfortunately and you were lucky he was insured. Best thing to do is just let the insurance deal with it, less stress and hassle for you, and if nothings perfect when you get it back. You just refuse the car back until its right. From experience they don't usually get it perfect first time round

During my 1 month stay on 8V forums (was previously active in 8P section) I can say two things:

1. Love your car, love the color
2. Sell the car, it's jinxed

Were you definitely off the roundabout when the accident took place? Just because, if you have an incident on a roundabout, insurers will insist on split liability 99% of the time

But in reality......why should that be a issue?

I love cars........ But I dont find the need to drive like a Knob and follow bright coloured ones around.

But also, why should I not be able to have something I want, because of someone else?

As I have said in a previous post, I am getting married next year and I have decided there is absolutley no good reason to keep it.

At the end of the days its metal on four wheels!

I've must admit I agree with this, since I've changed from my A3 to S3, I've had this problem with the local boy racers. Just my work commute for example through built up areas and the city centre I usually get some modified lupo or polo behind me trying to prove a point. Just because I've got a 300+ bhp car doesn't mean I'm going to race through built up areas near schools etc plus I'm not that eager to get to work early :blink:

But isn't it so satisfying knowing you could leave them for dust the second you decide? And the fact that you have a much nicer car. For me one of my dream cars?

That being said I'm usually too immature to sit smugly whilst they glare at my ***. I'm just as bad as the rest at heart :(

lol had the same, when they come up behind me I just stick the cruise control exactly on the speed limit and plod down the road. Then when we get to the lights and they pull along side I just look at them and smile, 9 out of 10 times they then just sit there on green waiting for me to go :D

Always go through insurance. If it wasn't your fault, your no-claims won't be affected anyway, and it saves hassle if there are problems down the line. What if there's damage you discover later that wasn't seen or repaired at the time? If you go through your insurance company you have recourse to get it fixed. If not, you have nothing.

In any case, you are required to tell them about the accident anyway, even if you don't make any claims. To not do so is fraud, and given you've now posted about the accident on a public forum, I would suggest that's not the most sensible idea.

If the other driver is uninsured, or for some other reason your insurance company can't get recompense elsewhere, then you will in all probability loose your NCD. Same if your insurance company and the other driver's decide to go knock for knock.
In your case it sounds like you will be OK though.

But I bet the other guy will deny responsibility, or at least phrase it so it's some level of mitigation.

A lot of companies do protection against uninsured drivers these days. I'm with one of them! I also have dashcams fitted so I'm prepared to argue with any company that tries to push any kind of split responsibility claim on to me (assuming I think it's unfair).
