Advice please - accident with cyclist.

Morning all,

Not a great start to the week. On the way to work this morning a bus began to pull out in front of me so I naturally stopped. Unfortunately the cyclist behind me didn't and went straight into the back of me.

Result is a dented boot lid and scratched bumper. In my 5 week old S3. I could actually cry.

Obviously, the cyclist isn't insured. Can anyone tell me where I stand in terms of making a claim and keeping/losing No Claims Bonuses etc? I have 5 years NCB but they're not protected.

With 99% of cyclists not being insured you can't make a claim against their insurance.
Its not a road traffic collision by definition as the only mechanically propelled vehicle damaged was the only one involved (yours, unless his bike was damaged?)
It could be interpreted as criminal damage as it could be said that the cyclist was reckless but good luck going down that route.
Do you have the cyclist's details? You could ask them to pay for the damage and if they don't you could look at pursuing a civil case against them. That would mean speaking to a solicitor which means time and money.
You could claim from your insurance but I think that would affect your NCB. Not that they make much differecne
 
Your NCB would be reduced by a year I would think. The best option is to try to recover costs from the cyclist if you have their details. Probably not worth taking them to court cost wise. What's your excess? If it's a big chunk of the repair cost you might find it cheaper to sort it yourself than make a claim.

I'm not really interested in pursuing him legally for any costs, its just not worth it.

The plan at the moment is to either;

a) Claim on my insurance if NCB remains unaffected
b) Sort the costs myself and ask the cyclist to make a contribution.

We had a chat at the roadside, he said he didn't have much money so trying to get him to cover the entire cost is going to be difficult without any legal backing (in the way of insurance etc). I'm going to probably ask him to pay what he can afford and hope he has a strong conscience.
 
Just one of those things life throws at us then I guess. If it was me and I had a nice shiny new S3 I would just get it sorted. Both options sound like a good plan. One of the reasons I got rid of my S3 was because of things like this, it kind of took over a bit. I saw your pictures and I'd feel like crying too!

Yeah I'm just taking it on the chin, going to dent the wallet just before Christmas but hey-ho.

Thanks - I was a little apprehensive about getting in touch as I didn't know how much advice I could ask for without then having to make a claim.

you've already left me a voicemail this morning as I'm arranging to have a named driver added, so I'll discuss options when I call to do that.
