Stupid Cow... Wrong lane..

Hello All,


Unfortunately my A3 1.8T has come to an end. The other day I was T-boned to the left rear of my car on a roundabout, the silly moron with pink hair is trying to say she isn't at fault. Here's a little information as I would appreciate any help on my insurance claim.

I won't go into to much detail of people involved, cars involved due to insurance purposes.

I was entering a roundabout in the right hand lane from Pytchley Road (A509), Kettering, Northamptonshire to continue straight on the A509 (You can use both right and left lane on this roundabout to continue on to A509 2 lanes) I had entered the roundabout with a vehicle on the left lane next to me however her intentions wasn't to exit at exit 1 or 2, as I've started to exit the roundabout with indicators illuminated at exit 2 she decided to try and go all the way round the roundabout (exit 3 or 4 possibly) missing 2 other cars by just inches. My satnav even shows you could use either lane to exit onto the A509 from Pytchley Road (A509). She impacted the rear of my car Smashing my whole left rear wheel arch, alloy and took half of my bumper off. She has told the insurance that she isn't liable (I have no idea how she cannot be liable on this).

There was no witnesses because I got out of my car furious and no one wanted to stop due to my anger. There was a camera on this exit she hit me on but no idea if it has captured the accident.

Surely using the 1st lane to use exit 3 or 4 on a roundabout isn't possible???

The police are also involved and said they will get back to me within 2 weeks of their investigation.

Unfortunately I'm only third party fire & theft and my insurance have told me if she doesn't claim liability then my car damages will not be paid for. What can I do ?!?!

No witnesses, theirs your problem, on the bright side your cars easily repairable not a write off.

I know exactly where you mean. I live in Barton Seagrave.
That roundabout is a pain in the **** with people choosing all sorts of lanes to go around.
Were there any injuries? And was a statement or interview completed with you?
The police are unlikely to provide any report unless there is a clear offence that has been committed, injuries or fail to stop (hit and run)

If it's a simple damage only accident, all right will be given to the insurance company to pick liability
 
I just would of said give me 300quid and forget about it failing that pass on your claim to 1 of those accident management claim things before they take on your claim they will assess it with you and if they think youv got a strong case they will take your car give you a courtesy and they will claim all there expenses from her insurance and that's when they do the insurance company up the bum
 
@kanecullen89 - Yes, the police took interviews in their car and statements. I have suffered whip lash however my partner has been in bed since the accident as she's in a lot of pain (car was hit on her side). They've also seized my SD card from my dash cam but it failed to record the accident as the memory was full. They did say they will contact me within 2 weeks with their investigation. But surely someone using the 1st lane for 3rd or 4th exit they would deem liable? I'm pretty ****** at my car being damaged and my laptop being thrown to the other side of my boot busting it's hinge.

There's also a CCTV camera covering my exit however no idea as to wether it caught the crash.
 
@Phil-1 - Unfortunately there is no markings on this roundabout at all but I don't believe there is a single roundabout in this country where you could possibly use the 1st lane to come off at the third or fourth exit??? She said to the police "he sped up" well hello you pick up speed after exiting a roundabout..
 
one of them chest nuts ayy,, btw I hope your partner gets a speedy recovery and realy was it that bad it smashed your laptop up the side
 
Was she traveling in the same direction as you, On your near side. Then turned into you as you continued in your lane for your exit?

If so, and she went around the roundabout and crossed your line of direction she is at fault.
 
@Deze2014 - Unfortunately yes, it's marked the chrome back of my screen also. Pretty gutted as I bought the laptop on finance as I'm a freelance website developer and it ended up costing me £1550 after interest.
 
@Phil-1 - Yes, she crossed my line of direction. I was coming off the roundabout and she tried to carry on to her 3rd exit in the nearside lane. She's also trying to dispute liability which I will not accept 50/50.
 
Don't worry. She hasn't got a leg to stand on. This happened to me a long time ago and the insurance sorted it. You can claim for your laptop under "Un-insured losses" get your GF to the doctors and make sure she is ok
 
@Phil-1 Ambulance attended to us however it was only a car ambulance and had to take her a and e myself which they prescribed pretty strong pain killers for me and herself. Hope your right on the not got a leg to stand on as I've not got the money to repair it myself and never seen my partner in this way before. Pretty devastating to be honest and I'm so furious someone could even try and dispute liability like that.
 
Disputing liability is the normal thing these days. If your partner is still in pain take her to A&E it's better to be safe then sorry.
Did you get photos of the road and car positions. What part of her car came in contact with yours?
 
Only managed to get a picture of damage to bother vehicles unfortunately. I keep asking to take her back to a and e but she don't want to go. She keeps feeling nauseous also which is worrying me, if she don't feel any different in the morning I'm going to drag her there.
 
Did you as the driver give statements? Or did you get interviewed?
Generally, the person they deem to be at fault will get interviewed and the other driver will give a statement.
The only difference to this is when it's too hard to tell who is at fault and both drivers get interviewed
 
She banged her head on the head rest but she's been feeling sick since the crash on and off. She's been a and e once I will take her again in the morning if she's no better.
 
it'll be knock for knock, it could be disputed you never checked your exit prior to
Manoeuvre - plus TPFT does not help your fight, laptop can be claimed on your house insurance also.
 
This is where having a dash cam makes all the difference :) maybe think about purchasing one for the next car it'd probably paid for itself in this instance a few times over if you had the accident recorded.
