Insurer **** up?!

Long story short both parties reversed and hit each but I am convinced that I was established and at a standstill and the other party admitted to me she was distracted by her kids and didn't see me. Anyway I am/was in the process of trying for 100% instead of 50/50 via my recovery loss company ULR. Whilst doing so my insurer (ERS) told them that I had already accepted 50/50 and it's all gone through. Therefore the recovery team could no longer chase for my 100%.

I was livid as apparently my wife called up on 10/09 @1610 to accept it.

1. I don't have a wife
2. If I did they are not on my insurance so how can they accept it

I left it with ERS to listen to this telephone conversation which I said I would also be interested in listening to. However this **** up may have cost me my increased premiums (gone up £150 this year) and my excess.

Where do I stand? I have asked for compensation. Should police be involved?

they should start again and let you chase the non fault
 
From what you say it sounds like you have been badly done to. I'm not surprised though as it seems fairly common for insurance companies to get together and split the liability in difficult to prove circumstances.
I would speak to them again, get them to put what they are saying in writing and then take it to the financial ombudsmen.
No way would I be taking it on the chin!
 
I will wait to see/hear what the telephone conversation is first. I won't be happy if it's my neighbour (whose the 3rd party) who called up.
