Need advice on K04 turbo

Due to a piston melt down, I recently had most of the engine apart, and decided to replace the CHRA, while I had everything disassembled. After first engine start, it starter to smoke from the turbo area when it warmed up. All hoses checked out ok, so I decided to remove the turbo again. I found oil inside the compressor side and in the intake and therefore did a measurement of the old and new compressor side flange and found this:

Can anyone confirm, which is correct for a K04-022?
 
why does it matter what the backplate and comp wheel thickness is? You need to fit the one that matches the comp cover
 
Because I want to know whether it is my compressor or the CHRA which is off standard, in order for me to purchase correct parts and maybe get my money back from the company at which I bought it.
 
Ok, but I don't want to ruin my chances of getting my money back by dissasembling the CHRA, so I will just return the unit. I think I'm going for a complete new turbo instead, just to be sure that everything is top notch.

I would think though, that the two sections which make up the backing plate will leak oil out into the intake, since they have no compression?
