Hi all i need to obtain some free or cheap legal advice regarding my nieghbour has mounted something on my side of the property
can anyone help please

thanks

What advice was you after, are you friendly with them? Tell them to remove it or you would, as it's on your property, just remember to hand it back to them, as they own whatever it is... it's like having an overgrown tree intruding your space, your allowed to trim it down to where the border ends, and throw the excess back onto their lawn/drive, as it belongs to them.

its a tv aerial mounted on my side of the chimney ive asked them to move it did nothing back in june, then in november they repositioned it in a even worse position than before and still on my side, never really got on with them so sent letter saying i woulkd like the offending aerial off my property in november, guess what still there.

I believe you are within your rights to go up, rip aerial off, and throw it back onto their side/roof.

Take it off without causing damage to it, then hand it back to them so they cant dispute that you took it off or it got 'lost' etc.

True. But it would be nice to disconnect the aerial and plug the coax into the mains........

That would solve the issue of not getting on with the neighbours...you'll get new ones once the bodies have been discovered :)

ive got to do this legally i have given them plenty of notice, any know where i can get legal advice cheaply?

I would suggest another talk with them, tell them they have 10 days to remove it or you will arrange for it to be removed at their cost. Put it in writing to them...recorded delivery etc etc.

Can the council help ?? I know they have a thing with Conifers.

Plus don`t remove it yourself get someone in and send them the bill

I dont see the need to over complicate matters, like JoJo says, if something is fixed to your property then you have every right (legally and morally) to remove it, and then give it back to them. What legal advice would you need exactly??

Thats true, dont put cost on yourself, at the end of the day they are going to be pee'd that you have taken their aerial off, i dont think they are going to be in the mood to pay you some money.

As already mentioned, have a word with the CAB and see what they have to say, otherwise, if you want to, take it off yourself and hand it to them.

Alternatively, if you want to get silly about it, park your car on their drive, block their cars in, go up where the aerial is, go right to the top and cut the wire coming from it, not so that you can see it though, that way, when they go up to investigate it, move the ladder away, and dont return it until they agree to take it off??

Just a few childish ideas by Im'mature Nilz :)

Im in a similiar situation with my border fence, or should i say their fence.

My neignbours rarly come out and cant even be ***** to mow their lawns, their fence (on my side is almost to the point where it it is about to fall down) its falling to pieces and is sloping at an angle.

It looks terrible and needs replacing as it makes my property look bad! and they are not maintaining their borders, i have asked them 3 times to sort it and get it replaced, i have havn offered to help them with it, but still nothing!

So what can i do? do they have a duty to maintain their borders legally?, im so tempted to knock the f***** down on a windy day and pretend it was the wind! then maybe they will have to replace it.

you are normally responsible for one of your boarders i.e the left hand one but you can build another on your land within the exsisting one

If it was my roof the aerial was put on, I'm going to give you a call.... and maybe Sidibear as backup! :)
