BAD WEEK!

Hi all just thought i'd post here so i can let some steam out and just relax.
Hope you dont mind. I'm 19 i've worked in the same job since 2007 first was part time so i could go college 5- 11 Last December decided to go full time need the extra money 2:30-11! But since going full time my pay has ALWAYS been wrong every month. First few months missing about £100-£150 but then it got to march where i was missing about £300 then May missing £600! Lol shouldnt of started thsi thread really its sooo long!

Ok first problem: Last saturday police gave me 3 points and £60 fine. Will get some photos of my tyres and i dont think there low! Only been driving since 11th Jan 08. Im not a boy racer and i take care of my car so when ever the tyres were getting low would change them straight away no question asked. I'm lucky i got off with 3 points and £60 he was going to give me 6points and i'd have to go court pay £1000 each tyres and what ever the fine was.

Second problem: Think my clutch and maybe flywheel gone on my A3! Ok i can get it fixed and would of this week but check third problem. And car kept over rev'in and losing power.

Third problem: Been suspended :banghead: But full pay...So i have to keep what money i have.
But may have to sell the car if i dont get a job within a two months max!
Heads all over the place!

3 points and £60 and you dont think they're illegal?. In which case you should have refused the ticket and taken it to court. If the tyres fine then no problem!.

Tickets are only a conditional offer....you dont have to accept them.

Sounds like you're having a rough one though, when it rains it pours eh?.

Me too having a bad week but nothing like yours! Mine's just cause my boss is off. Hope things start to pick up for you.

I got taken to court about 8 yrs ago for 4 bold tyres, averaging 96mph over 6 miles, driving without due care and attention and having a defective car cause my handbrake cable had snapped!

On the lucky side I managed to get off with 4pts and £210 fine! To be honest I haven't really got an excuse but I certainly leant my lesson as it could have been a whole lot worst!!!!

If you really don't think your tyres and illegal get them to a garage to be tested and see if they will give you a report.

ive had a crap couple of weeks to got a punture and a cracked window screen, my mot has ran out, i lost my job in november and cant seem to get another, i got 6 points and a fine and basically its a bag of poo

but you know what ash i still have my car there's food on the table and im happy so 2 fingures to the lot and heh it could be worse you could look like this....lol

so count your lucky stars and dont dwell on it or more bad look come's

Lol thanks for the picture blazin:superman: Aww mate dont say that lol i was thinking yesterday when i had a meeting if i get fired i'm gonna deck the guy. We dont really see eye to eye, he too sly for me. I think for now on if i'm ****** and want to get some one back i'll give blazin a shout the guy always got ideas going around in his head! All they said in the meeting mate was gross misconduct. Wouldnt say any more...

Ahh still got the crack in the window screen have you checked to see if your insurance will cover it? Sorry to hear about the last couple of weeks mate. Sounds lke a bag of poo, what you get the points for?


Yeah you still have your pride and joy so that still keep me happy lol. I can keep mine just can do any mod's! Main thing still got food on the table and a roof over your head. Yeah i could be homeless with no car or money lol no that be bad!

Ahh few people having a bad week lol! Thanks for that mate, hopefully they start to change for the better over the weeks. Whats wrong with your week mate? f*cking hell mine no way as bad as yours! Yeah your lucky could of been a lot worse. Your well lucky mate. Cant see the court being that easy these days, i know they will take into account if you need your car for your job etc.

But i know people who been caught doing over 100mph and all they got off with 6points and £1000 fine. And he actually a member on here! Got caught in his S3 back in April time. As the car been off road since then (few days after the clutch went)...There a garage not far from mine i suppose they wouldnt mind coming to check it and giving me a report. Thanks for the advice

They have not given me a reason just said grossmisconduct so in some way or form i've broken one of the company policy's.

I did refuse but they said i had a warrant out for my arrest for not paying an fine. And for not going court? If i had court i'd go i got nothing to lose. I paid my last fine straight away. So basically said there doing my a favour! They followed my car for about 15minutes! Before blue lighting and pulling me over.

Haha chin is up thanks for that mate. :rock: Wne to nandos and see transformers last night! GOOD FILM :) Love it if my car could do what they do lol. All i can do is look for another job that i'll be happy with. I suppose i can still take it to court. And There was another two people in my car who also said my tyres were not low.

As for not seeing eye to eye, you should have dealt with that earlier by approaching you Human Resource department, at least it would have been documented.

This depends on two things - the actual contract/disciplinary procedures and the length of service.

If he's been in the job less than 12 months then it's possible a company can drop an employee with no reason.

After 12 months service then an employee has a bit more protection. Dependent on the contract the company should follow the disciplinary procedure although there is no absolute legal right to this from the employee.

A company can suspend any one on full pay for no reason - suspension in itself is not disciplinary action taking place.

It is only if the employee is then called to a disciplinary hearing that the company should inform the employee what the issue is, normally after an investigatory hearing.

A company could dismiss if it is then explicit that gross misconduct will result in dismissal & that what the person has done is classified as gross misconduct.

I would definitely write everything down NOW and take records of everything - very useful if/when it ever goes to appeal/tribunal.

Thanks for that mate. Already informed a few people thats higher up than the person who was in the meeting for me. And i informed them back in January so all documented. With the one i dont see eye to eye with its just the fact is he doesnt do his job! lol

That seems to be the way it goes where ever you work

True enough for the 12 month quote
So, with the last quote l would assume that they gave a reason other than misconduct. If not then thats another piece of infomation that might be in your favour if it goes to tribunual.
Either way he will have to have eyes in the back of his head if l where you.:keule:

Anyway, get them tyres signed off for now, and if the MOT place can varify that the old tyres are ok, surley it's worth appealing the point?

That's a really good point actually - if you've been given a reason for being suspended and it's NOT classified as gross misconduct then you'll be in a stronger position, because that was their basis for investigating it.

That's why an employer should never specify a reason for suspending someone until an investigation is done and then a notice to attend a disciplinary meeting is given. It's only then that the employee should find out what the reason is for the disciplinary.

It's a jungle out there with employment law - good luck though, hope it sorts itself out, I work in that area so if you need any advice can PM me if need be. :thumbsup:

Sorry to hear this and I hope you get it all sorted and soon as well, I can only but imagine whats going through your mind at the mo.

As already mentioned, keep your head up and keep smiling, after all, things as bad as they may seem could be a lot worse :)

So they said you had a warrant out for your arrest for unpaid fines, didnt arrest you and issued you with another ticket?.

If you have been given a ticket for the tyres and you're sure the tyres are legal then just opt for the take it court option on the ticket. There's a section on the ticket that allows you to contest it.
