Need Advice about getting a full refund for my car.

Hi,
i bought a car 3 weeks ago and thought i had a problem with turbo or blowing somewhere:

Anyway i want for a service today at audi, and shocked at what is wrong with it:

Exhaust blowing - very noisy - Blowing from flexi Joint
next to cat' - requires new - all studs corroded - requires new cat' and all fittings
may require x2 oxygen sensors and turbo removing to replace studs

Labour Hours: 5
Total inc VAT: £2068.04

:O

So im gonna try get a refund for this, car isnt fit for the road and is unlikely gonna pass its MOT. I know i have rights on this as it was purchased from a dealer with warranty.

Any advice on this? Gonna contact the dealer tomorrow

Have you spoke to the dealer about it? I think if it is in road worthy in the first 6 months of buying the car (warranty or no warranty) they should pay for the repair of give your money back and that's the law I saw it on dont get done get Dom a few weeks ago.

Sorry to hear about your issues ENZO. If it helps, most of us have some problems with our motors when buying second hand. Does your warranty not cover this? Even if it doesn't, the cost should be much less with an indy than with a dealer :)

Now sounds like a good time for a turbo back exhaust :eyebrows:

Hang in there mate, my car has issues that i'm only just discovering 1 year later.

If its the one of the 2 flexi's that go from the manifold to the cat at the front of the car, one of mine split earlier this year and the first garage I took it to said I'd need a new cat with pipes costing over £400 just for the part.

Went to a recommended exhaust place and they replaced both flexi's without buying a whole new cat for under £200.
 
2 grand i love audi
anyway that flex can be changed for less that £100
 
gonna speak to the dealer tomorrow, if they refuse to refund or cover the repair costs what rights do i have ?
What can trading standards do?
 
they will not let audi do the work
its a very easy job to do the flex any local exhaust shop could do it

'You' as a consumer have rights when buying a used car wether its from a private sale or a dealer.

had it exactly 3 weeks, done about 300 miles since i bought it.

you have to give them the option to repair the faults first
but op you should tell the dealer he might just agree stright away to the repair .
 
Just echoing a few people here, get in touch with trading standards.

I had issues with a past vehicle I purchased and they were very helpful.

I hope you get it sorted :)

and they will tell him first thing to do is speak to the dealer that sold him the car
the dealer may sort it stright away
if he doesnt then its TS time

Hi I bought a car from Audi, with the warranty took the car for an independent safety check, because I am one hell of a suspicious Ba*****rd when it comes to garages. OH my Gord safety report,2 oil leaks 2differant tyres on the back with 3mm tread, Snagged seat belt and a couple of other minor points. Thanked the garage mechanic and took the safety report to Audi I had only purchased the car 3 weeks ago. They tried to weasel out of it. Looked under the good garage scheme,this garage was a member. Sat down and wrote a nice letter to the manager at Audi and named names and dates and gave him seven days to reply or I would send the same letter to head office and to the good garage. WOOOOOOW My mobile went white with the heat from this Audi garage the service manager phoned me up twice and then the technician phoned me up at seven o clock on the night. Took the car in the following day. Invited to talks with the garage Chief the following day could not have been more helpful . All work was done plus some minor work on plastics .The pen is mightier than the sword so put pen to paper.

on a car advertised as "excellent condition and maintained to the highest possible standard"
 
Almost no chance of getting your money back unless something catastrophic happens, they will have to fix it though.
 
all this talk of trading standards and ging into the garage guns blazing.... tsktsk

go in there politely ask he look to fix the exhuast and confirm the timing belt is not due, and if its due to change it and the waterpump. if he has replaced the belt ask to re do it due to pump leak. should have been spotted.

a pair of cats will no doubt cost the garage under 300 plus labour. if you wish to decat, buy the parts if they agree to fit them free of charge. be reasonable with them. if they dont play ball then look into the sale of goods act.
 
i got this reply from the dealer:
The vehicle was of satisfactory quality when it left our premises and also the exhaust was not blowing or there was no sign of bad emmissions.you were given the oppurtunity to fully inspect the vehicle and test drive.upon observation and comments you proceeded with the purchace.bearing in mind that the car was 7 years old and has been driven in excess of 100,000 miles and was free from major faults but minor,it can also be put down to driving conditions of the vehicle where the vehicle has probably been abused because we are surprised how you can state that the vehicle was not fit for the road bearing in mind that the mot was carried out by a independent garage.

so basically there saying ive done the damage, from my understanding corrosion damage occurs over a longer period than 3 weeks right?

anyone else been in a similar situation? its probably gonna end with me having to get these repairs done myself, so can anyone recommend a place for this work doing? £2000+ is just ridiculous
 
I quoted in a reply earlier 'within a reasonable time',youve had the car 3 weeks so you have every right to take this further!At the very least you are entitled to have the cars faults corrected........

you need to get advice from TS,not in a million years would i pay to get these jobs done out of my own pocket without a damn good fight.

Your call at the end of the day mate.

not gonna give up yet, if the dealer isnt gonna sort this out im gonna contact TS.
 
WRITE to the dealer, the 6 months thing is not just a consumer right, its the LAW, get trading standards involved straight away anyway because the dealer has already e-mailed you to try to avoid dealing with you

its not for you to prove the car was faulty when you bought it, its for them to prove it wasn't, which in 3 weeks of driving, pretty sure they wont be able to convince anyone you did £2000 worth of damage in 3 weeks and 300 miles

Sorry to be cheeky but if you bought the car on any kind of credit/finance your provider will fight your corner for you
 
Was it under a month since the mot? if so you could also involve vosa possibly. If within a month of the mot defects show up the mot test could be questioned, upto 3 months with rust related issues. From what your saying i would expect to see advisery issues on the exhuast on the mot, if not could be questionable.

Simply write to the garage asking that he corrects the issues within a reasonable time scale and of no significant inconvenience to yourself. explain that you know your rights as a consumer, quote him the sale of goods act, and inform him you will also take this matter further within 7 days if no satisfactory response.

You MUST give the garage the opertunity to correct it before working on the car elsewhere.

Sorry to hear of the issues with your car. I'm in Leeds, too and I wondered, did you actually get the car from the Audi dealer (presumably in Leeds)? Ive got family who've had serious issues with cars left with them, and had a few minor issues with them myself when they've been doing warranty work for me.

This isnt the case.

The finance providers wouldnt fight your corner - you would have to take up the issue with them direct as you would have technically purchased ther car from them.

I know this because I'm 6 months into a case fighting the finance company because I was mis-sold a vehicle :(

no it wasnt from Audi, but was from a dealer in leeds.
 
well, they told me it was just "general wear and tear" as the car is 7 years old, and theres nothing they can do. Said i should get the work done at a local exhaust specialist.

Should i take this further? Thinking i should contact trading standards now.

This is why I said contact trading standards first - just so you knew what options you have if any, get straight onto them tomorrow morning. In my experience they are pretty helpful and knowledgable.

The angle that you may be able to use is if the car was sold with those faults then its not 'fit for purpose'.

just an update

i went to an exhaust specialist for a second opinion on the work i need doing. They said its the CAT that needs replacing and its an expensive job wherever i have it done.

So theres no way im paying for this work, if it was just a couple of hundred quid tops i would have had it done myself.

Looks like im gonna have to take this to trading standards, though ive emailed the dealer to give them a chance to resolve this first.

Really annoyed, first audi and only had it a month :(
Would prefer a full refund as i could get an S3 now.
 
how much did they quote for the cat ?
how did they say its the cat audi said its the flex audi wont just change the flex thats why they quoted for a full cat with flex
who did you take the car to ?
did you get the qoute printed out ?
 
get all the paperwork for the flex replaced show trading standards
i still dont think you will get a full refund you will get it replaced when TS get involved

i went to an exhaust specialist (quote)

any exhaust shop that knows what there doing would not tell you to get audi to do it
think you need to find someone that knows what there doing
