What to do about my insurance and car

In April, some idiot in a Corsa undertook me on the M6 and cut back in, hitting my front end. My car has a fair bit of damage but his came out with a small dent. I went through the usual route with insurance and waited, I called my insurance the other day and they've said that they've closed the case since the other driver hasnt claimed off my insurance. This has left me in a bit of a pickle, my insurance company are no longer helping me sort my car out, is this legal? and any good idea what to do next? Ive tried contacting his insurance but haven't manged to get through yet. I'm only third party on the car so my insurance wont fix it.:banghead:

Im very much no legal expert, but i'm pretty sure you can claim of his insurance if fault is with the other party. When I had a no fault, my insurer had very little involvement past passing me to an "accident management" company who performed the process against the other insurer. During the process I rang my insurer to ask a question and they said "call your accident management company, we have nothing on file".

You may be able to contact one of these claims handlers directly (but be warned there is loads of sneaky credit-hire crap about), and instruct them to file a claim against the other party if you have the reg ect.

Seems suspect that somebody hits you and your insurer is telling you there is no recourse short of claiming through your own insuerer. Maybe the other party is insured with the same or group owned insurance company ;) Seems to me that this is the exact situation third-party cover is for?

Stick at it and maybe try CAB (Insurance) and there is always the Ombudsman after you follow complains proceedure if they still are not helpful.

I'm no expert, but have just come from months of insurance dealings with my own accident.
 
So by your accounts, the other driver has caused the accident, but not accepted liability, so you can't claim off his insurance? Or are you the one that is at fault based on you going into the back of him scenario, even though he caused it?

So WUTA3 is it worth going to an accident magagement company then?

Well, I wouldn't say do it myself ... they are slimey *******s and will probably say "Yep, we will handle it, and here is a courtesy car" wether they think fault is with the third party or not.

Just saying, there are or should be options, unless the third party cover explicitly denies you that by proxy with the third party insurer .... get proper advice ... ie, not mine :p

If you have their number, then you should call them up and ask why they are not admitting liability?

You should report this to the police and get them to admit liability if they are not playing ball! That's the only way you can make a claim against him/her? If witness was a passenger in your car, then you can't use them unfortunately, from what I've been reading.

I went with an accident management company to make a claim against a guy who went AWOL. Took 12 months, but I won the case in court, as he was a no show, and it's had no effects on my car insurance at all.
