Adding a name to your house deeds?

Does anyone know the cheapest way to add a name to your house deeds? And do I really need a solicitor to do it??

Give the Land Registry a call - they are really helpful and will tell you exactly what you need to do and I'm pretty certain it will be FOC (or if not minimal charge - certainly a lot less than a solicitor will charge). It is definitely worth ringing them as their website can be very, very confusing.

I dealt with them earlier in the year as part of sorting out my dad's estate. Back in the 1980's my parents had changed the ownership of their house to be 'tenants in common' coupled with a trust as part of inheritance tax avoidance. With the changes to IHT back in the late 2000's this rendered this way of owning their house un-necessary, however they never changed the ownership back to joint tenants. This made my job resolving the situation and transferring ownership solely to my mother more complex than it should have been.

I was expecting a load of hassle to resolve this but Land Registry gave me some very clear advice on what to do including what forms to complete and even what to put in the boxes on the form that weren't obvious, and all resolved without involving a solicitor.

Joe, def try land registry, lawyers will charge you a fortune doing the same thing.

Is the property mortgaged? If so then the deeds will be with the Lender I would have thought, in which case it might be a bit more faffing and they won't let you add a name to the deeds without it also being on the mortgage, although they can be more relaxed if certain conditions are met, such as the majority of the mortgage is paid off or the status of the tenants etc.

That's a very good point - I hadn't thought about the implications of having a mortgage (my parent's place was all paid up).

Just an update on this, you can indeed do it yourself, but you need three forms to fill in. The lady at LandRegistry kindly pointed out that it's not easy to fill in though, and best left with the solicitors to deal with it, who only need 2 of the 3 forms required!

I have no info on costs though...

You don't actually have deeds these days anyway - all computerised at the Land Registry. Hope they have good backups - LOL

Most deeds have been destroyed by the mortgage holders these day - shame they couldn't offer them to you before destroying them - but I guess it would have cost too much.

If you get a solicitor to change any details on your deeds through the land registry, the cost to do so is £ 180 + vat here in scotland.
