Hi all,

Just wondered if anyone is any good on e-bay related issues and could give me some advice on a problem i'm currently having.

I won a golf club (part of my dads birthday present for january) and paid instantly via the paypal thingy - job done, just had to sit and wait for it to turn up.

Then the seller has then e-mailed me to say he didn't get a high enough amount for the club so he's not going to send it to me. apparently he forgot to put a reserve on it??

Does anyone know if he's allowed to do this or has anyone had a similar experience with a seller backing out?

the guy has promised me a full refund (but it's not gone through yet), however the original payment only went through my account today.

i don't think he'll take the cash and run based on his 200+ positive feedback but if he does, i might have to enlist the help of the kent A.S-net members to deliver a whooping for me
 
he's not allowed to do this. Legally, if there is no reserve then he has to sell the item. I'veforgotten the case that set this precedent.

In the real world though, you're never going to sue him due to the costs involved. Let him refund you and look for another one. Just one of those things.
 
contact ebay immediately, when you bid both you and him entered into a contract for him to sell you the goods blah blah... and raise an issue on paypal and tell him you won the auction fair and square and you want YOUR golf club.

i've e-mailed ebay explaining it all and there going to look into the case for me.

just a bit annoying more than anything, I tend to base any purchase on both the item description and the seller's feedback score / comments so I thought i was doing ok.

guess I'll have to see what happens.

Wait until your money comes back, then flame him on the feedback for breaching a legally binding contract.

Yeah do that, its his fault not yours. He should have contacted you straight away. Wait for him to leave positive feedback before stinging him.

Also make sure hes refunds your payment through paypal otherwise you will recieve be knocked for fee for recieveing cash.
 
Refunding though paypal would only be at a click of the mouse, ensure he does this first, then leave negative feedback. Then send some hardcore porn to his address in a clear shrink wrapped envelope just big enough that it won't get through his letterbox. At least his neighbours will know he is a wankcer too.

Personally wouldn't bother waiting for Ebay to resolve anything, even used there Fair trade scheme before, but a complete waste of time.

Well, I've heard back from ebay and they've given him a warning about doing this kind of thing again...

It looks like this sale won't happen which is a bit of a pain in the @rse.

TDI - liking the pawn idea, personally I was thinking of a week old fish in a box but it's nice to have options.

Well sounds like you should go for porn to start with, followed by a **** for maincourse and fish for desert!

I really hate the way ebay don't ever really do anything about stuff like; this the wording is very clear that you are entering a contract to sell. /ubbthreads/images/graemlins/swear.gif! There just after the money.

bit of an update, I've just double checked the item description and he has stated that theres no reserve on the club so (in my book) he has to sell it.

failing that i've just got his address & phone number from good old BT.

the ebay item number is 7205491811 just in case i'm reading it wrong

Just checked and it definately says no reserve!

I would give him a call and see what he says...
 
Yeah he has stated in the description "no reserve" what a fool then saying that he has forgotten to put one.

I thought ebay was all about grabbing a bargain.

He took a risk not putting a reserve and it didnt pay off. He will have thought that this would attract more bidders.

I would point this out to ebay and see what they say, mention writing to watchdog or summat.

Have you got you money back yet as well as if not they need to get that sorted to.
