    Question What would you think if this happened to you?

    Seller has a car advertised in a car forum.

    Buyer enquires about the car and after a period of negotiation a price is agreed. Buyer arranges to view the car at the earliest convenience and to put a deposit down subject to viewing and test drive. Seller and buyer discuss method of payment of balance.

    In the meantime the buyer arranges finance for the car etc. confident in the seller and description of the car.

    The day before viewing the seller informs the buyer that there is suddenly another interested party who is willing to pay more for the car. Essentially the buyer is told he still has first refusal on the car but must now match the offer made by the other interested party, which is 700 more than the price agreed.

    How would you feel if you were in the original buyer's position?

    Seller is not on this forum by the way.

    Had the exact thing happen to me a few years ago.

    Went to buy a car that subject to a viewing and test drive I had agreed to buy at a set price. Got there (100 mile drive away) about to make the deal when I was told another person had offered 500 more and asked if I would match it.

    I told him to kindly gtf and went home.

    Next day he phoned me and apolagised and said I could have the car at the agreed price. I refused this and knocked him down another 200 and bought the car.

    Lad was a twat though, only bought the car as it was cheap.

    Walk away, seller sounds like hes trying to have one over on you.

    Tough one mate, 700 is a lot of money, and if I'm being honest, I would probably sell the car for 700 more if I didn't know you personally. I would happily return your deposit in full, and have the decency to tell you in advance which is what it seems to have done.

    As the buyer of course, you feel hard done by, and I would feel the same mate, as what you agreed on wasn't honoured in the first instance. But it's hard to stand in the way of someone making 700 more...

    turn it the other way round, what if the 2nd buyer flops and cant do the deal? would he take 700 less from you ? Er no, So walk away, plenty top cars out there to buy, remember "Cash is King"

    Perhaps i'm just too nice, or naive, or whatever, but wouldn't do that!

    Wouldn't have been 700 anyhow as stupidly this morning i told him i'd go up a few hundred if he'd honour the fact that we'd been chatting all week and had had a deal, if he didn't go back to the second guy who was originally offering 200 more than me. I then get a PM saying the other guys offered the 700 over my agreed price. So the guys obviously rang him anyway, i presume to play us off.

    Scumbag in my books.

    This is the frustration in these matters, you never know if you're being played off against a non-existent 2nd party just to bump the price up.

    You could be mean and say ok then set a date and not turn up! :D But if hes being genuine then thats a bit harsh, but does seem like hes getting you at it. Same happened to me, but he just sold it staright off the day before i was going to get it, so glad as the car i got now is far superior!!
    Its gone replaced with a mk2 golf gti 16v :D

    As all the others have said - Walk away.

    I bought my A3 from Derby (Drove up from London) - The guy wanted 11,000 for it - I ofered him 9300 as that was all i had. He told me to jog-on... A week later he rang mo to say i could have it.... I then said how about 9k - He laughed - Still got it for 9300 though

    Keep looking and you'll find a better car

    From your description, the buyer and the seller havent signed anything and no money has changed hands and the buyer has arranged finance before even seeing the car in the light of day. (sounds a bit foolish really)

    The seller has now been offered 700 more by someone else.

    Cant blame the seller for accepting a higher offer, theres so many time wasters about these days, what if you hadnt of turned up on the day of viewing?

    Its a harsh fact but a verbal agreement is worth the paper its written on.

    as advised i did walk away and perhaps unkle is right that i was being a little naive (not foolish though please!). the discussions i had had with this guy over the course of a week would in my opinion have left him in no doubt that i would come through on the deal unless the car turned out to be a lemon. in my experience time wasters don't go to the trouble and lengths to discuss every aspect of the car and deal that i did in this instance.

    live and learn.
