Hi guys.

Just wanted to pick your brains here.

A family member who lives in London had a timing belt replaced recently that led to a failure.

It was on a common rail VW engine.

Turns out that the wrong belt was supplied - ie - it was the correct number of teeth but 5mm narrower, which caused the belt to jump out of the pulley(ies) and cause engine damage (to what extent we don't yet know).

The belt spec changed after a certain chassis number supposedly.

Who is liable for this?

  • the belt supplier for supplying the wrong belt?
  • the fitter for not comparing the new belt against the old?
  • my cousin for not stopping the car before damage was actually caused?

The person who fitted it unless your cousin supplied it.

No the belt was got by the fitter who is trying to pass the buck on to the supplier (motor factor) for supplying the wrong belt.

Mechanics fault all day long, sue his ***..

I would probably say supplier as if all correct vehicle details were given, the correct part should have been supplied.

The supplier for supplying the wrong part(common for suppliers to do this using your reg plate/engine code to get parts) and the Mechanic for fitting the wrong part, he should have known better... my mechanic mate stresses all the time of getting the wrong part supplied, which wastes time and money.

just blame it on the boogie !!!
