    Angry Problem after purchasing an audi. PLEASE HELP

    Hi all.
    I'm stupid. There i said it so u don't have to.
    But please if you don't reply anything useful than please just don't

    I purchased my first car after working hard for a couple of years.
    Its an audi 2.0 tdi sport 5 door black 70k on the clock.
    When't to see it , it was close to home. From a small garage/SH car dealer.
    Checked the car over it was a lovely condition.

    Now the problem is that.
    It had listed as 2 owners.
    That it has BOSE, cruise control, Bluetooth and CD changer.

    I'm not really in to cars to be fair.
    I have got a mechanic friend to check the car over and test drive went fine.
    It had everything i needed like 5 door and black good tires and wheels, and close to home.
    On top of love at first sight they gave a good price for my stupid banger and i was over the moon.
    They also agreed to do the cambelt and rear pads which was a lovely bonus.

    Now after 3 weeks i get the logbook home and i see that actually im the 4th owner and not the third.
    A friend borrowed the car for a weekend and when he gets back he says to me that BOSE would sound better then standard.
    I was telling him that it has Bose, but no Bose on the grills.
    Also found out it doesn't have cruise, Bluetooth or that bloody cd changer.
    I know i haven't check it properly but cashing out 7600 pounds it was a lot of money and i was worried with engine and body condition more than the rest.
    They where really hiding the logbook now as i think back. But its to late.


    What i have done:

    Lucky me that i have taken screenshots whit my phone of the listing.
    I have called auto-trader and got the original advert text. ( the latest as they have edited it before took it off sale, but no proof or date recorded on auto-trader)
    I even kept the key tag what dealers use and the info is same. it says reg number, milage, 1 former keeper, etc.

    I have called the dealer and he says he could look in to a couple of hundred pounds compensation.



    Please i know i screwed it up so only reply if you have something good to add.

    from the point i have picked up the car to now the advert changed about 20%.
    it wont say owners but the spec is still wrong.

    I'd say that he'd be obligated to take the car back if it's been obviously mis sold to you.

    Only if you can actually prove it I hasten to say.

    Also, when did you buy it? Don't you get a seven day cooling off period?

    My heart goes out to you buddy. Don't be annoyed with yourself we all make mistakes. You did take some precautions such as the mechanic friend for example. I think weve all been there we get so excited about something we fail to check for other important stuff.

    You have also started a good case against them and well done with getting the original add, so you arnt stupid at all!

    Hopefully someone will come along soon with some legal advice or something more to add mate

    Ok you can take the car back and get your money back in full...the car has been sold to you 'significantly not as described'

    They have mis sold the car to you stating that it has extra spec that it clearly has not and therefore that is a fraud in way of technicality because the spec will increase the price of the vehicle. whilst we do check like stated above who actually runs any car with sucha fine tooth comb that it would assume a dealer is being honest.

    If you have the original listing and it clearly states things on the spec that certainly are not in the vehicle itself, I would be seeking the exact compensation amount from that you paid to be reimbursed to you without delay. If that failst to happen then you can either contact citizens advice and speak to someone within their motor sales/fraud department with what to do or call the police on a non emergency basis to have it looked into as like I said this is a fraud by false representation technically by selling goods for more than its actual value. Its much the same as a scenario such as someone selling a record on ebay and signing that record claiming it to be signed by someone like jimmy hendrix and selling it for a far higher value than what it actually is. Same thing, different way about it.

    If you are happy to get shot of the car for what has happened, take it back and use your consumer rights to demand the full sum of money back and hand them the keys back and find another mate. Who knows what else they have lied about... did you get receipts of the cambelt and pads change etc?

    i'm wondering shell i take it back or ask for a compensation maybe ?
    Don't want to go through the trouble of looking for another car and such.
    How much is ok £500 - £1000?
    Or just don't trust him anymore?

    Was the car cheap or expensive ?

    As they have a car service as well they just left the old timing belt and parts in a box which clearly says its a TDI Audi 2.0.
    When i have asked about the invoice for them they just said they done in and it has a warranty and that's it.

    I trust people to quickly ( makes me wanna bang my head to the walls for being an idiot.

    well the value was 7600 and maybe it was expensive as 3 previous owners and no spec, just a bog standard Sport.

    yes welsh both adverts clearly say bose, cruise, and cd changer although the latest advert from auto-trader it dosen't say 2 owners anymore.

    Had problems with main dealers similar so I wouldnt worry about it

    I would put them something in writing that you are not happy with whats happened, spell it out and give them a chance to rectify it

    mention that you have taken advice from trading standards regarding your consumer rights and that you look forward to hearing from

    them in writing with their offer to put the situation right

    Cruise control and the other stuff can be added, price it up and let them know how much it is

    The extra owner cannot be priced up but affects the trade price of your car.

    Send them the letter with quotes and they might offer you a decent amount.

    Be firm with them

    Owners doesn't really mean much on cars nowadays as long as its clean and well looked after. 3 owners again is nothing really, you might find that the first technical owner was an audi dealership if it was used as a demo/courtesy car.

    Im not sure on the legalities of it, but i think it is up to you to check things, theres probably a clause on the website/advert that says any information may or may not be correct at the time of writing, at the end of the day car dealers sell hundreds of cars, occasionally there are going to be mix ups.

    Cruise control is easy to spot though, as is a bose system & a CD changer. All of these would have been options on a sport model.

    However If the cars had work before the sale that you asked for, i.e servicing & cam belt the book should be stamped & they should be able to provide you with an invoice for the work.

    Id say as a few others have, put it down to experience and take a few hundred quid in compo, the dealers not going to take it back if theres nothing wrong with the car, especially not now its got another registered owner on it!

    I'l be going in for a chat with the owner tomorrow and show him what i got.
    I have printed out all the proof that i have.
    VW & Audi Retrofit Parts – Vehicle Electrics – Fault Diagnostics | HappyDayz says 200 for cruise, and 1300 for BOSE CD changer might be another 100.
    But to be fair i don't even trust the car now. I don't know what they done and what not.

    Il be returning the car for a full REFUND.

    Back to commute with the bus now for a couple of weeks.

    I disagree with you Dave, I think our man should be getting more than a few hundred quid in this situation

    Good luck with that...keep calm but make sure they know you are serious

    Its called rejecting the car, car traders who try to pull the wool over consumers eyes deserve whats coming to them in my opinion

    I find a large percentage of car salesman absolute scumbags, when you meet a good honest one its a miracle !

    This might help, it could however be a lengthy, long drawn out process that involves going to court, but give it a shot.

    I took one back and didnt need to go to court, you give them a chance to rectify it, which obviously they wont want to do in this case, therefore it would actually be in their interests to give our man his money back, two weeks is short enough to reject the car as not as described

    Why on earth are car dealers all scumbags.
    How can i trust one from now on,.,,,,

    Booked in at APS at 1. If they say the car dosent have the parts fitted the 100% refund. If it has and everything is fine with it. Then I she'll get a hefty compensation. Ps: missing a years MOT what could it be ?

    The fact they wont issue yo0u with a receipt for the timing belt change etc causes me concern.... Mate I would go through trading standards and get the entire amount back because you can easily find another vehicle of same spec at that price with a trustworthy dealer

    I think youre right AVANT, turns out they also did the clutch and dual mass flywheel, well thats what theyve written in the service book.

    I suggested that the OP gets the car inspected by an independent VAG specialist, usually an inspection is about an hours labour, so around £60, to ascertain whether the above has really been done in their opinion.

    It doesnt sound great to be honest mate, however im hoping that APS say that everything has been done as noted, if so the choice is then yours.

    Personally, I would be getting the car back for a refund, thats just me though and im picky like that, if things aint right from the start, how is it going to progress??

    Theres a few bits and pieces that dont add up, so ask yourself, what else is hiding??

    When you say its missing an MOT, do you mean you dont have the paperwork, if so, there is a way of checking all the MOTs on a car, if you have a look in the A/S3 forum, im sure there is a link in there to get the info.

    The Mot history on the vosa website doesn't show an mot.

    so there was no MOT in 2012.

    LOL...no worries.

    Its very unusual that it didnt have an MOT for that year, which would also mean that the car would not have been able to be taxed at some point.

    Has the car been parked up for a while, has it been damaged and been off the road for repairs in that time, many questions to be asked.

    Silly question, but was a hpi check done on the car, if so what was the outcome, if not, can you do one and see what comes off that. If the car is damaged/recorded and it was not advertised as such, you defo have grounds to get the car back for a refund.

    Now i have called these up.

    First Stoke Audi OK
    Second Preston Audi (Books says 18872 - 29000 on the phone)
    Third RS-Autos ( the guy on the phone nows the car and remembers the owner)
    Could not confirm the exact records but he can see having 2 records.
    He did confirm the last owners name from the logbook and that it had a private plate.
    He said he needs to run it through the system but yeah all ok with the car.?????
    And the last entry from the garage i bought it from will be checked 1300 today.

    Somethings not adding up mate, for me there are too many discrepancies, just get the check done at APS and make the decision, personally, I would be taking the car back and getting a full refund.

    Ring DVLA and discuss it may just be a mistake, when I looked at the price last night there were that many different models I can see why that might happen...problem is once there is doubt with a car...it mushrooms...the inspection today should put your mind at rest either way.

    DVLA say they cant see anything on their computer.
    Yeah after the answer i get from APS i will decide what to do.
    Don't really want to go down the root of searching for another car and definitely not commuting with the bus. That's £200 a month.

    see how it goes with the inspection , do the vin numbers match ? HPI was ok, did you do the guarantee with them ?

    At £7600 it was probably slightly underpriced, heres two valuations from wise buyers and whatcar. If you wanted to keep the car & you got some compo from the dealer, you could be in for a bargain, bose or no bose! However as has been stated you may be able to hand the car back as it was mis sold.

    I certainly dont think you should be mentioning the name of the dealer yet in bad light, if at all, that could jepordise your case if they find you have been bad mouthing them on a public forum.

    At the end of the day a car dealer is out there to make money, with cars theres so many ways & means to rip unsuspecting people off & most people wont have a clue.

    At the end of the day if you want a car with no issues and 100% backup you should buy a new car, failing that a second hand one with a full 12month dealership warranty for peace of mind. In my mind everything else is a gamble! Ive heard too many horror stories recently of experiences with indy garages, enough to put me off buying a decent car from one ever again if im honest!
