    ARRRHHHH!!!!

    Some Kn*b just plled out on my at a junction and i ran in the back of him

    Smashed the front grille and bumper to peices, also pushed both headlights back, although not enough to damage the rad.

    Naturaly i got out and went hell for leather at this guy, and to make it worse he had a real bad attitude, stated asking whether i was insured, and sniffing me as it to see if i had been drinking

    All he could say that it was my fault as i ran in the back of him, and that he was looking forward to tanning my insurance for a good wiplash claim!!!

    If my wife wasn't in the car with me i would have really lost my temper and prob of smacked the guy.

    Looks as though it can be fixed, but ive only just got the car back from having a new fual pump fitted yesterday and was looking forward to a few trouble free miles.

    Insurance excess if 400 aswell which makes matters worse.....

    Absolutely gutted..

    Sorry to hear about that but shouldn't you keep distance ? but than again with some idiots on the road, bumping some one doesn't have to be your fault

    slightly confuse by your first sentence. Where you sitting behind him at a junction and he started to move off then stopped? Or did he pull out of a side road onto your main road on which you were driving on and you then hit him?

    The latter, I'd have phone for the police to have him charged with dangerous driving.

    sounds fishey lots of guys are braking hard and claiming you ran in to them for a claim .... this thing is happening on a big scale you wana phone the police see if any cameras are on the scene to prove it ....

    Just to clarify, i was on a main road and he was coming out of a side road, he just managed to get out in front of me before the impact.

    As for witnesses, the only other person was my other half, although i'm not sure if her word will count for much being a spouse.

    Yeah i have a split grill so might change - if it wasn't for the headlights i would just swap the bumper and brill and it would not be too bad.


    Direct Line are closed now, so i have 12 hours to think about whether to claim or whether to buy a facelift front i suppose.

    I think that happened to my work. I guy hiring one of our cars ran into the back of an old R reg vector on a roundabout. hirer said the guy went, then stopped without any reason on an empty roundabout. Cost our insurance 13,000 - personal injury. Sounded all too fishy to us, we fitted a new indicator to the hire car and it was fine....

    Sorry to hear that, guy sounds like a arsehole. How bad is the damage? Any chance of photos? If not so bad get a new bumper and grill? Save your insurance going up and make your car look alot better

    Gutted for you mate - regardless of what happened, it's still your pride and joy that's damaged.

    A similar thing happened to me years ago when I had a four month-old Ford Puma. A guy in a white van pulled out in front of me as I was crossing a roundabout, and my NSF hit the offside of his van just behind the driver's door. We exchanged details, not admitting liability - although when he started mumbling I was "going too fast" I yelled that I had right of way - and left the scene with no witnesses stopping.

    The damage was very light - just a cracked headlight lens, dented wing and scuffed bumper - and I wasn't sure whether to claim with a 500 excess. Nothing happened after that. There was no counter-claim, so six months later I bought the parts myself, found a brilliant panel beater to paint them, and fixed the car myself at almost half the cost of my excess.

    OK, just been out to strip it to see exactly how bad the damage is.

    Definately needs a new grille, both the deadlight mounting brackets are snapped, the bumper needs replacing.

    Can anybody confirm that if i dont claim, but the other driver claims off my insurance, will i loose my no claims?

    I have decided not to claim at this stage until i price up the parts to sort it myself.

    Anybody getting rid of a front end?!

    This sounds like a staged accident to me. Did anyone see the programme on the TV about people setting up accidents so they can milk the insurance for some whiplash cash

    I would inform Direct Line that you believe he caused an accident intentionally - they will investigate it.

    What sort of car did he have, was it a heap?

    Thats not your fault - you couldnt have kept your distance as he pulled out in front of you...

    Go all the way, tell the truth and look for CCTV.

    But thats his fault - fight it all the way..

    But, what my mate did a few years ago, is got another mate to be a witness (who wasnt there) and his g/f and he won the case! The guy said my mate reversed into him when he smashed into the back of him ??? Plonker.

    But CCTVs your best bet tbh...

    Yeah the car was a total heap, toyota carisma to be exact but it could have only been worth 500 max.

    The more i think about it the more i think he has just done this to get a personal injury claim out of it.

    I am having a bit of a similar incident at the moment myself!!!

    Last september i was driving up a single lane road when i went round a blind bend and cliped wing mirrors at 15mph. I was in my 98 discovery and the woman was in a Saysang rodius it was neither of our faults BUT she got out shouted ran about phoned THEN i found out now that she is claiming for bust ribs!!

    Anyway

    my adive

    phone your insurince company ASAP tell them ALL the facts and then email them all the details and pictures of your car. Do this even if you are not claiming just tell them you are informing them just incase a claim is made against you. This is what i did as my damage was only 30. doing this will help, if they are contacted by the other drivers insurance company they will have your facts to hand.

    Belive me insurance your companies will fight this all the way.

    Were the police or ambulance ambulance called?? if not then he has NO evidance that you caused the injury. the stupid woman called them in my incident and it took 30 minutes to get her back out the car!!! even though i have photos of her out and on the phone!!

    It's very easy to claim for whiplash. The thing about whiplash is it can take a few days to kick in. You could just turn up at the doctors days later, say you have a sore neck and the next thing you know you have a cheque for 3k in your hand.

    People like that really get on my nerves, they are just pri*ks!

    Fight it all the way mate, don't let this guy think that he has got away with it, just because you hit the back of him, he thinks that an automatic free claim on your expense.

    You know, for around 120 you can get those small camcorders and an 8GB DS card. Just mount it on the dash so instant evidence should you require it.

    Hmm! Did you see him at the junction prior to him pulling out? If so then perhaps you should have anticipated him doing so and slowed down a tad! Driving is a dodgy game these days and you have to think, and look further than the end of your bonnet. Why does everyone on here automatically side with the audi driver? do you think they are infallible? You have only heard one side of the story! Guy could have been speeding, racing, could be a bad driver? I'm not saying he is, but try to view the post from all angles before diving in with your vitreous diatribes against a driver who can't defend himself. And before you ask, I'm a member of the IAM, and also an EFAD driver.

    This is just a forum firebobby, i'm sure nobody has the time to pick through all the tiny details to work out who's fault it is.

    Bottom line is that the 'audi driver' as you put it had right of way, you cant just pull out into oncoming traffic.

    I am not siding with anyone, but based on the facts presented it looks like a staged accident. Most people involved in an accident will, if they are in the wrong be civil about things. It is obvious to me that if someone pulls out onto a main road as cars are approaching knows they are in the wrong, so why would they be so aggressive. The only thing I cannot understand is... how he managed to get out far enough to be hit in the rear. That requires some precise driving as any damage to the side of the car would immediately be his fault. Must admit though, I view every car sat at a junction to be dull enough to pull out.

    Re: the facts. YOU don't know either, so why conjecture? The original poster has given his opinion and version of what happened, so why throw the other scenario in? Are you deliberately trying to upset him? Isn't writing your car off on someone trying to pull a compo claim bad enough?

    Oh, I forgot tact wasn't your thing. Like the person who had his car keyed; "firedavebobby" hops in and says something like "oh well if your car was parked on the pavement then you basically deserved it"

    I dont see why you should apologise, but anyway it would seem that if the OP's info is correct that he's well & truly been setup, but the things to ask in this claim is the other drivers vision test, does he wear glasses, should he wear glasses, etc etc, all these things are relevant in these matters & honestly the lawyers would if neccessary drag all this up, I saw a trainee lawyer do this for me once & the other party were made to look so stupid they really were, a guy inside the pub was 4-5 metres down the bar & he reckoned he saw the accident through a brick wall, lol, landlords son & the person who pulled out was a yocal, so even the smallest things are relevant mate that can win/lose a case, if the guy is supposed to wear glasses for driving that can easily win the case, its facts in court not fiction that wins.

    I did not start this thread for the other forum users to become judge and jury regarding my missfortune.

    The thread was started to enable me to vent some frustration, and to hopefully get some moral support - which i have receieved....from most.

    Whether people believe my side of the story or not, i will not loose sleep over it, and as you quite rightly said, its only my side of the story.

    You are more than welcome to voice your opionions on this, and anything else on the forum, but i would bear this in mind next time you need someones help on here.

    Sorry to hear about your car...
    Unfortunately insurance companies seem to take the line that if you run into the back of someone, its your fault. They don't seem to take into account whether the IDIOT just pulled out infront of you 2 seconds before impact and there was nothing you could do!

    The problem with driving nowadays (making myself sound old!) is that its not YOUR driving you need to worry about - its the idiots around you.

    I was driving from Aberdeen to Old Trafford a couple of weeks ago (needen't have bothered after Liverpool tanking us!), and beside Bolton the road has chevrons - and signs saying 'keep 2 chevrons behind the car infront'. No problem... but then some knob will always cut in between you and the car infront! Earlier on my travels, I was involved in a VERY nasty accident where some IDIOT ran into the back of me on the motorway when traffic slowed down. He got out and said 'sorry I wasn't paying attention' - but wasn't charged with anything (I have no idea why not!).
    At the time I felt fine, although was taken to hospital in an ambulance to be checked over. A couple of days later I started getting sorer and sorer, and now - (2 weeks later) I'm in agony! Like posted earlier - whiplash can take days to come, and is usually masked by adrenaline at the scene of the accident, and even for hours / days later.

    To be honest, you'd be aswell claiming your own car off your insurance, as if you're going to pay the 400 excess for the guys claim, then you'd be aswell getting your own car repaired for free at the same time.

    This saves Insurance Companies lots of admin and hassle which doesnt doesnt always mean the right outcome.

    Ive been in a 6 car shunt before (among other `incidents`)and its a nightmare! Lies, arse covering and fraudulent injury claims are common place unfortunately.

    Regardless of blame, I can only wish the OP best of luck in resolving this matter with a `fair` outcome.

    Update

    Hi all,

    Just a quick update, my car is fixed now, better than before so its all good in that respect.

    That said, i have just recieved a letter from a solicitor stating the the other guy is claiming personal injury - surprise surprise!

    Anyway, his version of events is total tosh, totally fabricated! where do i stand from here? as it is his word against mine do i have anything to worry about? i will obviously appoint representation from my side, but just got me a little worried now - can't be bothered with all the hassle!!

    Any suggestions would be appreciated,
