    Gutted....

    Absolutely f'ing gutted, just returned home from doing a deal on an S3 at an Audi main dealer. Did a quick MOT check using VOSA and it transpires the previous owner has done a Marty McFly and gone back in time with my S3.
    I would have thought an HPI check would have picked this up??

    A few more details would be good.
    I mean A full HPI check would tell if the car had been "rung" or do you mean the mileage is wrong? or MOT history isnt right??

    The car has been clocked. I've left a deposit which I will obviously be getting back from them. Somehow I don't think a main dealer would want to be exposed for selling a clocked car.
    I just can't understand, surely this would have been picked up having run a full HPI report? Unless of course the VOSA MOT database isn't linked into HPI??

    At lease you wont be out of pocket and stuck with a clocked car.

    I don't envisage there being any problems getting my deposit back, it's more the fact I spent ages trying to find and negotiate the deal on "the one" which now transpires to be dodgy. The amount of wasted time, petrol and energy etc is just bloody annoying really

    Dont ask for your money back....Demand for it back! Make out that they were trying to sell you a dodgy car, They know that if you spread the word there reputation will go downhill highly losing them customers and sales.
    If i were you id stay away from this only god knows what else maybe wrong with it if the've managed to clock it! As harsh as it sounds dont settle for second best...

    Have no fear once I've received a response/my deposit back i shall most certainly name and shame, wouldn't want anyone else coming a croppa on this

    Hold on a minute, the dealers might have been unaware...just like you.

    I dont think naming and shaming the dealer is really worth it, however posting the reg number and some vehicle details would be worth posting so people looking for an S3 are aware.

    i agree, sound the dealer out first and see there reaction. if they are genuine and helpful then thats cool. if not then hall of shame

    When i HPI'ed my car i had a simular proplem but mine was a genuine mistake, The HPI showed that...

    The cars first serivce about 10 months after being bought from new that it had 38,000 on the clock! But the first MOT in July 2006 showed 32,500 so i looked into it and it was that the service was carried out at 3,800 miles not 38,000 miles.
    But this is obviusly isnt a mess up. Look on the MOT certificate to see were it was MOT'ed. See what theve got to say about it.

    i think the dealer should be named.
    its not naming and shaming its just bringing to light they may or may not have checked the cars history.and in future should check their cars out.
    either way they are selling a clocked motor which should be bought to light along with the cars details
    they should have no problem giving you your deposit back as it would make it alot easier than having trading standards paying them a visit im sure

    Certainly not interested in this S3 anymore, already on the hunt for another, i just want an honest car

    Hmm thats weired. Whats the point in people selling clocks telling you how many miles are shown on them? Seconyl i asked my audi dealer and they told me they have to program the clocks with your mileage and this can only be done once.

    Just to add, if your correct them why would anyone buy a second hand ECU as your mileage wouldnt mean ****.

    never heard anything like it on any other site to be honest.

    so does that mean if someone has a bad experience with a main dealer,they get away with it so more people can experience the same problem???

    if so some unlucky person on here could end up handing over hard earned cash for this car

    It is possible to "correct the mileage" of a 8l s3.
    BUT surely the service history held by audi uk would show it made no sence?
    Doesnt a HPI check come with a promiss that they would pay out if the car was found to be faulty? dodgy??
    I dont want you to name the garage but are we talking An Full blown main audi dealer?

    Yes we are talking about a fully blown main Audi dealer.
    The service history is held by Audi and shows nothing untoward BECAUSE there is nothing stopping someone from driving say 40k miles without taking it near a dealer/MOT station, then clocking/removing 35k miles and then having it serviced/MOTed showing 5k miles?
    Or in this case stupidly MOTing with 20k miles less showing than the previous MOT, then 3 months later having it MOTed again (having added 20k miles in just 3 months) and then selling it a short time later having disposed of the dodgy mileage showing MOT = making it appear to have been off the road for a short period and getting away without having to service it and obviously getting a preium for not having probably about 100k+ plus showing on the clock.... he's obviously cerebrally challenged as he didn't realise these details were recorded by VOSA

    I think the law basicaly means...
    we cant and shouldnt say a company has knowingly done unlawful or incorrect things without ALL THE FACTS.
    we are at this point just knowing parts and making the rest up on assumptions.

    i defo agree with tom.. go talk to the dealers, they probably didnt know, they advertised a car that is not to the description, so your entitled to your money back.. i had a simular problem recently i went to buy a car to only do a text check on the way up to find out it was a CAT D... sorted it all out, the guy didnt know himself so after us both being gutted, walked away from the sale.. no problems.

    This whole idea of watchdog and naming the dealer is so rediculous.. sounds like an honest mistake. However if you dont get your deposit back (which is highly unlikely) then its a different matter..

    Sorry to hear it didnt go as well as you hoped.. but it wasnt ment to be.. im sure you'll find a better car now. Just be patient with it.

    sorry i didnt actually do a seach as like i say ive never heard of not being able to name a company or person that has done wrong wether they knew they were doing wrong or not.

    like i say its not naming/shaming its bringing to light other people should be aware of the car they are selling that has been found to have been clocked before handing over hard earned cash

    no one has said they are aware of the car being clocked although they will be informed by the person who left a deposit and the matter should be looked into by the main dealer before being put up for sale again.

    all that has been said is a car they are selling has the wrong mileage.no one has said they are aware of it and are were prob not aware

    put yourself in the same situation that the potential buyer is in and you might have a different view.
    if you completed the purchase yourself and parted with hard earned cash would you be saying the same thing?

    so as no one has accused the main dealer of knowingly selling a clocked motor why cant they be named?

    But there is nothing there to say that you cannot state that "I went to Audi dealer in .......... and found these facts about the car....". These are facts, which plainly state what happened and if you can substantiate your statement, then there is no case for libel action. This leaves the reader free to make up their own mind about the incident.

    If, on the other hand, you say that this Audi dealer knowingly sold you a clocked car, then you would have to be able to prove it in court, that the dealer was indeed aware of the issue. This could be quite difficult to prove and would come under libel legislation.

    So, if you fall into the first instance, then there is no reason for moderators to start editing posts.

    Would you not agree Voorhees?

    I can't see where the enforcement of this rule is going. Stating that a clocked car is being sold by a particular Audi dealer is simply stating fact. Accusing them of deliberately hiding this information and suggesting they sell clocked cars is totally different.

    I think the thermostat I brought from an Audi dealer 6 months ago is faulty; surely I can say where I brought it from? Saying this doesn't accuse them of anything does it? I'm not saying I'm right, I'm asking the question, surely my example doesn't breach UK libel law, but it’s the same thing, a simple fact?

    totally agree with this statement,exactly what im trying to say.

    no point naming the dealer anyway,they will just shift it on to another dealers or send it to auction.

    according to whats been said,you could face court action if you name the dealers you bought your thermostat from though

    lets just hope no one turns up on here in a few months after buying this car thats all i can say.

    some people will only buy from dealers because they think they are getting peace of mind

    think it would be best just to post the registration number,that way your not naming and shaming the dealer as some people think?
